第一條           

國立成功大學(以下簡稱本校)生物科技中心(以下稱本中心)為辦理本中心教師評審相關事項,依據本校組織規程第三十二條、本校各學系(所)教師評審委員會設置辦法及相關法令規定,設本校生物科技中心(以下稱本中心)教師及研究人員評審委員會(以下稱本會),並訂定本辦法。

Article 1       

National Cheng Kung University Center for Bioscience and Biotechnology Faculty and Research Fellow Review Committee Charter (the Committee) is established according to Article 32 of the NCKU Organizational Regulations and the faculty review committee charter of individual departments / graduate institutes of NCKU of the Center for Bioscience and Biotechnology (the Center), and applicable laws, and regulations.

 

第二條           

本會置委員六至九人,由下列人員組成之:

一、當然委員:由本中心主任兼召集人。

二、推選委員:由本中心會議自本中心專任教授或研究員推選五至八人為委員,已同時擔任校級教評會委員者,不得再

          擔任之。

三、如本中心符合推選委員遴選資格之專任教授或研究員未達應推選總數時,得由本中心會議自校內外選聘專長相近之

          教授、研究員,或由本中心副教授、副研究員擔任委員,惟教授或研究員之人數不得少於三分之二。

Article 2      

This Committee shall be formed with six to nine members described as follows:

1.    Apparent members: The director general of the Center shall be the convener.

2.    Elected members: The Meeting of the Center shall elect five to eight participating faculty members or 

       research fellows of this Center as Committee members, except for those who are already members of the

       faculty review committee of this University.

3.    When there are less qualified participating faculties or research fellows than required, the Meeting of the

        Center may recruit professors or research fellows with similar expertise outside of this University or       

        designate associate professors and associate research fellows of this Center to be committee members,

        provided that the total number of professors or research fellows shall fill at least two third of the seats.

 

第三條           

本會委員任期一年,連選得連任。

教師於奉准借調、休假研究、全時進修研究、出國講學或留職停薪期間,不得擔任本會委員。

本會推選委員在任期中出缺,由候補委員遞補。不足時,另行推選委員遞補,其任期以補足所遺任期為限。

Article 3       

Members of the Committee serve a term of one year, and terms may be renewed after their expiration.

Teachers and researchers on approved secondment, sabbatical leave, full-time advanced studies research leave, on abroad lecturing or research leave, or on leave without pay, may not serve as a member of the Committee.

When a Committee member is vacant during the team, his/her seat shall be filled by a wait-listed Committee member. A re-election shall be held when the vacancies cannot be filled, and the succeeding representative shall only serve the remaining term.

 

第四條           

本會開會時,以召集人為主席,召集人因故無法主持或遇有迴避情形時,其代理主席,由本會委員共推之。

Article 4       

The convener shall be the chairperson of a Committee meeting. Other Committee members shall elect a member to chair the meeting from among themselves when the chairperson is absent or steps aside for avoidance of conflicts of interest.

 

第五條           

本會審議下列事項:

一、專任、合聘或專案教師及研究人員之聘任、升等、聘期、解聘、停聘、不續聘、資遣原因之認定等事項。

二、兼任教師及研究人員之聘任、聘期、解聘、停聘等事項。

三、名譽教授等相關教授之聘任事項。

四、其他有關教師及研究人員評審之重要事項,及有關規定需由本會審議之事項。

Article 5       

The Committee shall review the following matters:

1.    Determination of the cause(s) of appointment, promotion, length of appointment, dismissal, suspension,

        denial of renewal, and layoff of participating, jointly appointed, or project faculties and research fellows.

2.    The appointment, length of appointment, dismissal, and suspension of supporting faculties and research

        fellows.

3.    Appointment of emeritus professors.

4.    Other important matters in relation to the review of facilities and research fellows and other items

        required for review by this Committee as specified in the related regulations.

 

第六條           

專任教師及研究人員之聘任、聘期、解聘、停聘、不續聘,由本會依循本校教師聘任辦法暨本校研究人員聘任及升等辦法等相關法規審議通過後,送非屬學院教師評審委員會審議。

Article 6       

This Committee shall review and pass the appointment, length of appointment, dismissal, suspension, and denial of renewal of faculties and research fellows with respect to the Faculty Appointment Regulations and regulations governing the appointment and promotion of research fellows of this University prior to handing over the outcomes to the faculty review committee of other colleges for review.

 

第七條           

本會開會時,除教師法或專科以上學校兼任教師聘任辦法另有規定外,非有委員三分之二以上之出席不得開議,非經出席委員三分之二以上之同意不得決議(有應行迴避之情事者,不計入出席委員人數)。

本會委員為副教授或副研究員擔任時,對教授或研究員之聘任審議案,應迴避不得參與表決。但一般審議事項,不受限制。

Article 7       

Unless otherwise provided for in the applicable listing rules of the Teachers, a Committee meeting shall be seated by at least two thirds of all Committee members, and a resolution shall be made by at least two thirds of Committee members present (members stepping aside from the meeting for avoidance of conflicts of interest will not be included in the attendance) at the Committee meeting.

Except for general affairs, committee members who are associate professors or associate research fellows shall step aside from the discussion and voting of proposals to review the appointment of professors or research fellows.

 

第八條           

本會開會時得視需要邀請有關人員列席報告或說明。

Article 8       

Where necessary, related roles shall attend a Committee meeting as guests to present a report or explanation.

 

第九條   

本會委員審議案件時,有下列各款情事之一者,應自行迴避:

一、本人或其配偶、四親等內之血親或三親等內之姻親或曾有此關係,為當事人者。

二、與當事人曾有指導博士、碩士學位論文之師生關係者(學位論文指導教授)。

三、其他本人與當事人間有利害關係,經本會決議應予迴避。

四、近三年發表論文或研究成果之共同參與研究者或共同著作人。

五、審查該案件時共同執行計畫。

本會委員審議案件認有前項以外之特殊事由應迴避時,得向本會申請迴避。

有具體事實足認本會委員就審議案件有偏頗之虞者,當事人得舉其原因事實向本會申請該委員迴避。

前二項申請,由本會決議之;本會認為委員有應迴避之事由,而未自行迴避或申請迴避者,亦同。

本會委員擔任兩級教評會委員,對同一審議案,依迴避原則處理,並只得於前一級教評會中投票,因故未出席前一級教評會者,方得於後一級教評會投票。但該審議案須該委員說明者,本會得請該委員說明之。

Article 9     

A member shall recuse himself or herself from the review if one of the following circumstances occurs:

1.          Where the member himself or herself, or his or her spouse, any of his or her relatives to four degrees of kinship, or a relative                by marriage within three degrees of kinship, or a person previously of such relationship with the government officer, is a                      party to the matter.

2.          The member was the teacher instructing in the dissertation or thesis, or was the thesis dvisor of the party.

3.          The Committee decides on the recusal due to a conflict of interest between the member and the party.

4.          A co-participant or co-author in a published paper or academic research over the past three years.

5.          Jointly execute the plan while reviewing the case.

If a member of the Committee deems it necessary to recuse himself or herself in the review of a case due to any reason other than those listed in the previous paragraph, he or she may seek recusal from the Committee.

When there is physical evidence to consider that the member may be biased toward the case under review, the party may apply to the Committee for the recusal of said member, and provide reason(s) and evidence.

The Committee shall determine application in the preceding two paragraphs, which shall also apply if the member fails to recuse or applies for recusal when there is a circumstance that warrants recusal.

If a member of the Committee serves as a member of two levels, he or she shall follow the principle of recusal, and may only vote in the previous level. If he or she fails to attend the teacher review at the previous level for just cause, he or she may vote in the next level of the teacher review. However, the Committee reserves the right to request an explanation from the member as to why they failed to attend the previous level.

 

第十條           

本辦法未盡事宜,依教育部及本校相關法規規定辦理。

Article 10    

Any matters that are not regulated in the Charter shall be administered according to the related regulations of the Ministry of Education and NCKU.

 

第十一條     

本辦法經本中心會議通過後,報請非屬學院核轉校教師評審委員會核備後實施。修正時亦同。

Article 11    

The Charter shall be passed by the meeting of the Center and approved by the faculty review committee of other colleges before taking effect. Any amendments shall be processed accordingly.
