一、   國立成功大學(以下簡稱本校)為保障職工權益,疏解職工糾紛,促進校園和諧團結,特依公務人員保障法第七十七條及本校組織規程第二十四條之規定,訂定本要點。

1.   To ensure the rights and interests of staff and worker, settle staff- and worker-related disputes, and facilitate campus harmony and unification, National Cheng Kung University (hereinafter “the University” or “NCKU”) established the Organizational and Review Guidelines of the Staff and Worker Appeal Review Committee (hereinafter “these Guidelines”) in accordance with Article 77 of the Civil Service Protection Act and Article 24 of the NCKU Organizational Regulations.

二、本校職員、校聘人員、駐衛警察及工友對本校所為之管理措施或有關工作條件之處置認為不當,致影響其權益者,得於知悉管理措施或處置達到之次日起三十日內向本校職工申訴評議委員會(以下簡稱本會)提出申訴。

2.    If the staff, contract employees, campus security guards, and workers of NCKU deem any management measures or relevant working conditions rendered by the University to be inappropriate and thus to have affected their rights and interests, they may, within 30 days of the next day of being informed of said measures or conditions, file an appeal to the NCKU Staff and Worker Appeal Review Committee (hereinafter “the Committee”).

三、本會置委員十一人,任一性別委員應占委員總數三分之一以上,由下列人員組成:

(一)不同一級單位之職員及校聘人員代表各三人,並分別由職員及校聘人員互選產生,選務工作由人事室辦理。

(二)駐衛警察代表一人、工友代表二人,分別由駐衛警察及工友互選產生,選務工作由總務處辦理。

(三)教師代表一人,由各學院推薦專任教授一人,非屬學院之系、所、館、室、中心由教務處推薦專任副教授以上教師一人,由校長遴聘。

(四)法律學者或專家一人,由校長遴聘。

3.    The Committee consists of 11 members; members of any gender shall account for at least one third of the total population and shall comprise the following persons:

(1) Three staff representatives and three contract employee representatives of different first-level units; these members are elected by and among the staff and contract employees. The election is hosted by the Personnel Office.

(2) One and two members representing campus security guards and workers, respectively. The guard and worker representatives are elected by and among all security guards and workers, respectively. The elections are hosted by the Office of General Affairs.

(3) One teacher representative. Each college recommends one full-time professor for the position; the Office of Academic Affairs shall recommend one full-time associate professor (or professor) representing noncollege departments, institutes, library, offices, and centers. The president then selects and appoints a teacher representative from these candidates.

(4) A legal scholar or expert appointed by the president.

四、本會委員為無給職,陳請校長聘任,各委員任期二年,得連任之。委員因故出缺時,繼任委員之任期至原任之任期屆滿之日為止。

4.    The Committee member positions are unpaid. Each member is appointed by the president with a term of 2 years and may be reappointed. When a member post becomes vacant for any reason, the term of the successor shall be the date of the original term.

五、本會主席,由委員互選之,並主持會議,任期一年,連選得連任。主席因故不能主持會議時,由其指定委員一人代理主席。

5.    The Committee chairperson is elected by and among the members; the chairperson is responsible for hosting meetings with a term of 1 year and may be reappointed if elected. If the chair cannot host a meeting for any reason, he/she shall appoint one member as the deputy chairperson.

六、本會開會時應有委員二分之一以上出席,除評議決定應經出席委員三分之二以上同意外,其餘事項之決議,以出席委員過半數同意行之。應行迴避表決者,不計入出席人數。

6.    At least one half of the total members must be present at each Committee meeting. Except for review decisions that require approval of at least two-thirds of the total members, resolutions for other matters require approval of half of the members present. When a member abstains from voting to avoid a conflict of interest, his/her presence at the meeting is not counted.

七、申訴人於案件開始評議前,得聲請與案情有利害關係之委員迴避,聲請案由本會議決。委員對申訴案件有利害關係者,應自行迴避。

7.    Prior to a review appeal, the appellant may request the recusal of any Committee members who are stakeholders of the case in question; the appeal is resolved by the Committee. Members who are stakeholders of the appeal case in question shall excuse themselves from the appeal review.

八、本會行政相關工作,由下列單位辦理:

(一)職員、校聘人員及駐衛警察之申訴案:由人事室辦理。

(二)工友之申訴案:由總務處辦理。

8.    Administrative affairs of the Committee are handled by the following units:

(1) Appeals associated with staff, contract employees, and campus security guards are handled by the Personnel Office.

(2) Appeals associated with workers are handled by the Office of General Affairs.

九、本會之經費由本校行政管理預算經費勻支。

9.         The incurred Committee expenses are covered by NCKU’s administrative management budget.

十、申訴應以書面為之,載明下列事項,由申訴人或其代理人簽名或蓋章:

(一)申訴人之姓名、出生年月日、性別、住居所、國民身分證統一編號、服務機關、職稱、官職等。有代理人者,其姓名、出生年月日、性別、職業、住居所或事務所、國民身分證統一編號。

(二)請求事項。

(三)事實及理由。

(四)證據。

(五)管理措施或有關工作條件之處置達到之年月日。

(六)提起之年月日。

申訴不合前項規定,其情形可補正者,應通知申訴人於二十日內補正。逾期未補正者,本會得逕為評議。

10.       An appeal that specifies the following items shall be filed in writing, and shall be signed by or bear the seal of the appellant or his/her agent(s):

(1) The appellant’s name, date of birth, sex, place of residence, national ID number, affiliated agency, job title, and position. Where there is an agent, the appeal shall state his/her name, date of birth, sex, occupation, place of residence or place of office, and national ID number;

(2) The claims;

(3) The facts and reasons;

(4) The evidence;

(5) The date the management measure or working condition of concern was served; and

(6) The date of filing.

Where an appeal fails to comply with the foregoing requirements but is deemed amendable, a notice shall be sent to the appellant, requesting that he/she amend it within 20 days. If the appellant fails to amend the appeal within the period stipulated, the Committee may review the appeal directly.

 

十一、本會應於收到申訴書及相關完整資料後,以書面檢附申訴書影本及相關書件,通知原措施單位提出說明。

原措施單位應自前項書面通知之次日起七日內,將案件事實、理由及處理意見,連同其他相關資料,回復本會,並應將說明書抄送申訴人。但原措施單位認為申訴有理由者,得自行撤銷或變更原措施,並函知本會。

原措施單位逾前項期限未提出說明者,本會得逕為評議。

11.      Upon receipt of an appeal form and complete relevant documents, the Committee shall send a written notice with copies of the appeal form and relevant documents attached to the unit from which the appellant received the resolution (hereinafter “the unit concerned) and request that the unit provides an explanation.

The unit concerned shall, within 7 days of receipt of the written notice stated in the previous paragraph, provide the Committee with the case facts, reasons, handling opinions, and other relevant information and cc said information to the appellant. However, if the unit determines the appeal claim to be reasonable, it may abolish or change the measure at its discretion and notify the Committee.

Where the unit concerned does not provide any explanations within the period specified, the Committee may review the appeal directly.

十二、本會就書面資料進行評議,必要時得通知申訴人、原措施單位及關係人列席說明。如有特殊申訴案件時,本會得推選委員數人組成調查小組,先行調查。

申訴無理由者,本會應為駁回之決定。

12.        The Committee reviews an appeal by reviewing the submitted written documents. When necessary, the Committee may request that the appellant, the unit concerned, and other stakeholders provide explanations at a meeting. Where there is a special appeal case, the Committee may select several Committee members to establish an investigation team to explore the case concerned in advance.

              The Committee shall reject an appeal when no reasons are provided.

十三、本會評議決定,除有應不予受理或停止評議,而逕行通知申訴人及原措施單位之情形者外,應於收受申訴書之次日起三十日內作成評議決定,並以書面通知申訴人及原措施單位。必要時,得予延長二十日,並通知申訴人。

本會於作成評議決定前,得建議停止對申訴人原措施之執行。

第一項期間,依第十點第二項規定補正者,自補正之次日起算;未補正者,自補正期限屆滿之次日起算。

職員如對評議決定不服者,得於評議書送達之次日起三十日內,向公務人員保障暨培訓委員會提出再申訴。

校聘人員、駐衛警察或工友如對評議決定不服者,得依其他有關法令規定提起救濟。

申訴人向本會提出申訴者,同一案件以一次為限。

13.      Except for the circumstances where a notification of appeal rejection or termination for the appellant and unit concerned is necessary, the Committee shall review the appeal and formulate a decision within 30 days upon receipt of an appeal form; the Committee shall notify the appellant and unit concerned of the review results. When necessary, the Committee may extend said period by 20 days and notify the appellant.

Prior to the appeal review decision being made, the Committee may suggest the measure imposed on the appellant be suspended.

For those asked to supplement relevant documents pursuant to Paragraph 2 of Article 10, the period specified in Paragraph 1 shall be calculated from the day after the requested documents are submitted; in case of failure to do so, the period shall be calculated from the day after the expiration date of the period for submitting supplementary documents for an appeal review.

If the staff member in question disagrees with the decision made, he/she may, within 30 days of the day following receipt of the appeal decision form, issue a reappeal from the Civil Service Protection and Training Commission.

Provided that the contract employee, campus security guard, or worker in question disagrees with the decision made, he/she may file for remedies pursuant to other relevant acts.

An appellant may file an appeal to the Committee a maximum of once for the same matter.

十四、申訴案件有下列情形之一者,不予受理:

(一)無具體之事實內容者。

(二)未具真實姓名、服務機關或住所者。

(三)申訴書不合法定程式不能補正或經酌定相當期間通知補正逾期不補正者。

(四)提起申訴逾法定期間。

(五)申訴人不適格者。

(六)本校所為之管理措施或有關工作條件之處置已不存在者。

(七)對已決定或已撤回之申訴事件重行提起申訴者。

(八)對不屬申訴救濟範圍內之事項,提起申訴者。

前項第六款情形,如申訴人因該管理措施或有關工作條件之處置之撤銷而有可回復之法律上利益時,不得為不受理之決定。

第一項第八款情形,如為應提起再申訴、復審,而誤提申訴者,本會應移送再申訴或復審受理機關,並通知申訴人。

14.        An appeal will be rejected if it meets one of the following conditions:

(1) Failure to state any actual facts or content.

(2) Failure to specify the real name, affiliated agency, or place of residence.

(3) The appeal form does not comply with these Guidelines and is not eligible for document supplementation, or the appellant fails upon notification of supplement expiration to provide the required documents during the period provided.

(4) The appeal form is lodged after the period requested in these Guidelines.

(5) The appellant is ineligible.

(6) The original management measure or working condition in question no longer exists.

(7) A reappeal is based on the same appeal that has been

resolved or withdrawn.

(8) Claiming for items that are beyond the scope of appeal remedies.

Under the circumstances specified in Subparagraph 6 of the last paragraph, if the appellant has recoverable legal interests arising from the revoking of the management measure or working condition rendered, the Committee shall not make a decision of case not entertained.

Under the circumstances specified in Subparagraph 8 of the last paragraph, if the appellant mistakenly files an appeal that should be a reappeal or petition for deliberation, the Committee shall transfer it to an agency with the jurisdiction of appeals or petitions for deliberation and notify the appellant.

十五、申訴人於本會作成評議決定前,得撤回申訴。申訴人撤回申訴後,不得就同一原因事實重行提起申訴。

15.      Before the Committee makes a resolution for an appeal, the appellant in question may withdraw the appeal. After withdrawal, the appellant may not issue another appeal based on the same reason and fact.

十六、申訴程序中,申訴人、原措施單位或其他關係人,就申訴事件或其他牽連之事項,提出民事訴訟、刑事訴訟或行政訴訟者,應即通知本會。

本會依前項通知或依職權知有前項情形時,應以書面通知申訴人停止申訴案件之評議;俟停止原因消滅,經申訴人書面請求後,繼續評議。

申訴案件全部或一部之決定,以其他訴訟之法律關係是否成立為據者,本會得在其他訴訟終結前,以書面通知申訴人,停止申訴案件之評議;俟停止原因消滅後,繼續評議。

16.      During the appeal process, the appellant, unit concerned, or any other related parties shall notify the Committee if they take a civil, criminal, or administrative action related to the appeal case or other matters involved.

            When the Committee acknowledges the circumstances specified in the last paragraph because of said notification or its authority, it shall send a written notice to the appellant in question regarding suspension of the appeal review. After the cause for suspension ends, the review shall continue upon written request filed by the appellant.

            When the decision on an appeal, in whole or in part, is premised upon the existence or nonexistence of certain legal relations to be determined in another action, the Committee may notify the appellant in writing regarding suspension of the appeal review until that action is concluded. After the cause for suspension ends, the review can continue.

十七、本會應對申訴案件提出討論並經評議,決議後擬定評議書由主席署名。

本會之評議、表決涉及委員個別意見,應對外嚴守秘密;涉及隱私之申訴案,申訴人之基本資料應予保密。

17.        The Committee shall formulate a resolution for an appeal through discussion and review, after which a review decision form shall be signed by the Committee chairperson.

The review and voting process during Committee meetings involves the individual opinions of each Committee member and shall be kept strictly confidential. For an appeal involving privacy, the basic information of the appellant shall be kept confidential.

十八、評議書應記載案件之事實、理由及兩造陳述,如有建議補救措施,並應提出具體建議。

評議書應陳請校長核備,並以本校名義函送申訴人及原措施單位。

18.       A review decision form shall specify the facts, reasons, and statements of the two parties involved in the appeal case and propose specific suggestions if compensation is recommended.

            A review decision shall be reported to the president as well as the appellant and unit concerned notified through an official letter in the name of NCKU.

十九、本會評議決定,如原措施單位認有與法規牴觸或窒礙難行者,應列舉具體理由,陳請校長同意後,交付再議。但以一次為限。

19.      If the unit concerned determines a review decision to be contradictory to an act or to be floundering, it shall list specific reasons, obtain approval from the president, and file a reappeal request—but only once.

二十、本要點如有未盡事宜,依有關法令規定辦理。  

20.      Matters not specified in these Guidelines shall be undertaken in accordance with relevant regulations.

二十一、本要點經校務會議通過,陳請校長核定後實施,修正時亦同。

21.         These Guidelines shall be implemented upon approval by the University Council and ratification by the president. Any amendments shall be processed accordingly.
