一、國立成功大學（以下簡稱本校）為遴聘無給職法律顧問，以提供法律 諮詢，特依教育部及所屬各機關(構)學校無給職顧問遴聘要點，訂定 本要點。

Article 1. To appoint nonsalaried legal advisors for relevant consultation, National Cheng Kung University (hereinafter “the University”) promulgated its Directions for the Appointment of Nonsalaried Legal Advisor (hereinafter “the directions”) according to the Directions for Appointment of Nonsalaried Legal Advisors in the Ministry of Education and its Affiliated Agencies, Institutions, and Schools.

二、 本校得聘請無給職法律顧問一人，提供有關校內事務涉及民事、刑

事、行政法規及其他相關法律問題之諮詢服務，並協助處理相關法律 事宜。

Article 2. The University may appoint one nonsalaried legal advisor, who is responsible for providing consultation services regarding the University’s internal matters related to civil, criminal, and administrative law; other legal problems; as well as assisting with relevant legal matters.

三、 本校遴聘之無給職法律顧問應具備下列資格條件之一：

（一）執行律師業務五年以上。

（二）曾任法官或檢察官，其年資與執行律師業務合計達五年以上。

（三）學有專精之法學教授或專家。

Article 3. The nonsalaried legal advisor must possess at least one of the following qualifications to be appointed:

(1) Have practiced as an attorney for more than 5 years.

(2) Have attained over 5 years of service as a judge or prosecutor combined with years spent serving as an attorney.

(3) Serve as a law professor or expert with expertise in jurisprudence.

四、 本校無給職法律顧問之聘任，由人事室簽陳校長擇聘，聘期一年，聘 期中隨時檢討其適任性，期滿後依業務需要檢討，必要時得簽請續聘 之。

Article 4. The Personnel Office shall file a report to the president regarding the appointment of a nonsalaried legal advisor. The duration of the appointment is 1 year, during which time the competence of the legal advisor may be assessed at any time. After the expiration of the employment period, the University shall review its operational needs and renew the contract with the legal advisor if necessary.

五、 本校無給職法律顧問每月支領兼職費新臺幣五仟元。如係支領月退休 金之退休人員，其向各機關（構）學校所領取之兼職費總額最高以每 月新臺幣二萬元為限，並應填具切結書，切結同意如每月支領無給職 顧問兼職費總額超過新臺幣二萬元時，繳回其溢領之金額。

Article 5. The nonsalaried legal advisor shall receive a part-time fee of NT$5,000 per month from the University. Retirees of each agency, institution, and school who receive monthly pensions may be paid a maximum of NT$20,000 per month as a part-time fee; moreover, an affidavit must be signed to ensure that amounts exceeding NT$20,000 will be returned.

六、 本要點未規定事項，依有關法令規定辦理。

Article 6. Matters not covered by the directions shall be handled in accordance with relevant regulations.

七、 本要點經主管會報通過，報教育部核准後實施，修正時亦同。

Article 7. The directions have been approved in the Chief Administrators Council meeting and reported to the Ministry of Education for approval before implementation. The same shall apply to all amendments to the directions.
