第一條 國立成功大學(以下簡稱本校)為善盡社會責任,使校務資訊公開透明,依政府資訊公開法及大學法第三十九條規定,訂定本辦法。 Article 1 The National Cheng Kung University Regulations on the Disclosure of University Affairs Information (hereinafter “the Regulations”) are promulgated by National Cheng Kung University (hereinafter “the University”) in accordance with The Freedom of Government Information Law and Article 39 of the University Act to implement social responsibility and disclose university affairs information to the public.
第二條 本校校務資訊之公開,依本辦法之規定。但其他法令另有規定者,依其規定。 Article 2 The disclosure of university affairs information shall comply with the Regulations unless otherwise specified.
第三條 本辦法所稱校務資訊,指本校各單位於職權範圍內作成或取得而存在於文書、圖畫、照片、磁諜、磁帶、光碟片、微縮片、積體電路晶片等媒介物及其他得以讀、看、聽或以技術、輔助方法理解之任何紀錄內之訊息。 Article 3 University affairs information mentioned in the Regulations refers to information made or obtained by each unit of the University within their authority, in the form of writing, graphics, photographs, hard drives, magnetic tape, optical discs, microfilm, integrated circuits, or other mediums that enable reading, viewing, listening to, or interpreting information stored in these mediums through other technologies or supportive measures.
第四條 為符合政府資訊公開法,並保護個人隱私,下列校務資訊,除依第六條規定限制公開或不予提供者外,應主動公開: 一、各項校務運作之規章。 二、本校各單位之組織、職掌、地址、電話、傳真、網址及電子郵件信箱帳號。 三、行政指導有關文書。 四、中長程校務發展計畫、業務統計及研究報告。 五、預算及決算書。 六、書面之公共工程及採購契約。 七、支付或接受之補助。 八、校務會議、行政會議、教務會議、學生事務會議、總務會議、研究發展會議、校務發展委員會及校務基金管理委員會會議紀錄。 前項第四款所稱研究報告,係由政府機關編列預算委由本校進行之報告或派赴國外從事考察、進修、研究或實習人員所提出之報告。 Article 4 To comply with the Freedom of Government Information Law and protect personal privacy, the following university affairs information shall be voluntarily disclosed, except for the information specified in Article 6, which shall be restricted from publicization or provision. 1. Regulations and rules concerning all functions related to the University’s affairs. 2. The organization, responsibility, address, telephone number, fax number, web address, and email address of each University unit. 3. Documents related to administrative guidance. 4. The Middle- and Long-Term School Development Plan, business statistics, and research reports. 5. Budgets and final accounts. 6. Written records of public constructions and procurement contracts. 7. Subsidies issued or received. 8. The Minutes of University Council Meetings, Administrative Meetings, Academic Affairs Meetings, Student Affairs Committee Meetings, General Affairs Meetings, Development Council Meetings, University Affairs Development Committee Meetings, and Endowment Fund Management Committee Meetings. Research reports mentioned in Subparagraph 4 of the preceding Paragraph refer to reports made by the University or personnel that are sent abroad for on-site investigation, advanced study, research, or internship under the government’s budget.
第五條 校務資訊之主動公開,應選擇其適當之下列方式行之: 一、刊載於成大校刊、成大新聞或其他出版品。 二、利用電信網路傳送或其他方式供公眾線上查詢。 三、提供公開閱覽、抄錄、影印、錄音、錄影或攝影。 四、舉行記者會、說明會。 五、其他足以使公眾得知之方式。 Article 5 University affairs information shall be disclosed on the University’s own accord through the appropriate measures listed below: 1. Disclosed in NCKU’s university publication, NCKU news, or other publications. 2. Transmitted by internet or other means so that such information can be searched online by the general public. 3. Read, transcribed, photocopied, voice recorded, video recorded, or photographed publicly. 4. Disclosed through press conferences or presentations. 5. Other means that are sufficient for the public to acquire knowledge of such information.
第六條 校務資訊屬於下列各款情形之一者,應限制公開或不予提供之: 一、經依法核定為國家機密或其他法律、法規命令規定應秘密事項或限制、禁止公開者。 二、公開或提供有礙犯罪之偵查、追訴、執行或足以妨害刑事被告受公正之裁判或有危害他人生命、身體、自由、財產者。 三、本校作成意思決定前,各單位之擬稿或其他準備作業。但對公益有必要者,得公開或提供之。 四、本校為實施監督、管理、檢(調)查、取締等業務,而取得或製作監督、管理、檢(調)查、取締對象之相關資料,其公開或提供將對實施目的造成困難或妨害者。 五、有關專門知識、技能或資格所為之考試、檢定或鑑定等有關資料,其公開或提供將影響其公正效率之執行者。 六、公開或提供有侵害個人隱私、職業上秘密或著作權人之公開發表權者。但對公益有必要或為保護人民生命、身體、健康有必要或經當事人同意者,不在此限。 七、為保存文化資產必須特別管理,而公開或提供有滅失或減損其價值之虞者。 校務資訊含有前項各款限制公開或不予提供之事項者,應僅就其他部分公開或提供之。 第一項所定應限制公開或不予提供之校務資訊,因情事變更已無限制公開或拒絕提供之必要者,本校應受理申請提供。 Article 6 Disclosure of university affairs information shall be restricted or ceased if the content of such information pertains to any of the following: 1. Information that is classified by law as national secret, information that shall be kept confidential or the disclosure of which should be limited or prohibited according to other law or regulations. 2. Information whose disclosure or provision may obstruct the investigation, prosecution, or execution of criminal affairs, may obstruct a criminal defendant’s right to a fair trial, or may jeopardize the life, body, freedom, or property of any third party. 3. Information drafted or prepared by each unit of the University before a decision is finalized, excluding information whose disclosure or provision is in the public interest. 4. Information that is obtained or produced by the University to perform supervision, management, inspection/investigation, or enforcement, and whose disclosure or provision potentially impose difficulties or disturbances on achieving the objectives. 5. Test, certification, or appraisal information related to special fields of knowledge, skills, or qualifications whose disclosure or provision may threaten fairness or implementation efficiency. 6. Information whose disclosure or provision may infringe on personal privacy, professional secrecy, or the right of public release by copyright owners. However, if such information is deemed necessary to safeguard the public good or protect people’s lives, bodies, or health, or that the people concerned have expressed consent to such disclosure or provision, then such information may be disclosed or provided. 7. For cultural assets that require special management, information whose disclosure or provision may cause the cultural assets in danger of losing value, in whole or in part. Only the parts of University affairs information excluding matters restricted to limited disclosure or provision according to the aforementioned paragraphs may be disclosed or provided. In the event that limited disclosure or rejection of provision are no longer necessary for information specified in Paragraph 1, the University shall accept the request to disclose and provide such information.
第七條 本校應依當事人之請求,就所保有之個人資料檔案,答覆查詢、提供閱覽或製給複製本。但有前條情形之一者,不在此限。 Article 7 At the request of the person concerned, the University shall respond to inquiries, allow reading, or provide copies of the person’s information file archived in the University’s database, unless any of the conditions mentioned in the preceding Article are met.
第八條 中華民國國民及依法在中華民國設有事務所、營業所之本國法人、團體,得依本辦法規定,向本校申請提供校務資訊。持有中華民國護照僑居國外之國民,亦同。 外國人,以其本國法令未限制中華民國國民申請提供其政府資訊者為限,亦得依本辦法申請之。 Article 8 Nationals of the Republic of China (ROC), juristic persons, and groups that have legally established offices or businesses in the territory of the ROC may request university affairs information in accordance with the Regulations. This also applies to nationals residing abroad and holding an ROC passport. Foreigners may request university affairs information in accordance with the Regulations only if the laws of their countries do not restrict ROC nationals from requesting government information in those countries.
第九條 向本校申請提供校務資訊者,應填具申請書,載明下列事項: 一、申請人姓名、出生年月日、國民身分證統一編號及設籍或通訊地址及聯絡電話;申請人為法人或團體者,其名稱、立案證號、事務所或營業所所在地;申請人為外國人、法人或團體者,並應註明其國籍、護照號碼及相關證明文件。 二、申請人有法定代理人、代表人者,其姓名、出生年月日及通訊處所。 三、申請之校務資訊內容要旨及件數。 四、申請校務資訊之用途。 五、申請日期。 前項申請,得以書面通訊方式為之。其申請經電子簽章憑證機構認證後,得以電子傳遞方式為之。 Article 9 A completed application form stating the following information is required when requesting university affairs information: 1. Applicant’s name, birth year/month/date, national identification number, household address, mailing address, contact phone number. If the applicant is a juridical person or a group, then the name, registration number, and office or business address shall be clearly stated. If the applicant is an alien, foreign juridical person, or foreign group, then the nationality, passport number, and identification documents shall also be provided. 2. If the applicant has a legal representative, clearly state the representative’s name, birth year/month/date, and mailing address. 3. State the content and title of the university affairs information and the number of documents. 4. State the purpose for applying for such information. 5. State the application date. The application in the preceding paragraph may be done through mail or, if verified by an electronic certification authority, through electronic transmission.
第十條 本校應於受理申請提供校務資訊之日起十五日內,為准駁之決定;必要時,得予延長,延長之期間不得逾十五日。 前項校務資訊涉及特定個人、法人或團體之權益者,應先以書面通知該特定個人、法人或團體於十日內表示意見。但該特定個人、法人或團體已表示同意公開或提供者,不在此限。 前項特定個人、法人或團體之所在不明者,本校應將通知內容公告之。 第二項所定之個人、法人或團體未於十日內表示意見者,本校得逕為准駁之決定。 Article 10 The University shall finalize a resolution regarding the provision of university affairs information within 15 days following the acceptance of such a request. The period may be extended when necessary, but the extension shall not exceed 15 days. If the university affairs information requested in the preceding paragraph is associated with the legal rights or benefits of certain individuals, juridical persons, or groups, a written notice shall first be sent to such individuals, juridical persons, or groups, to solicit their opinions, except when such individuals, juridical persons, or groups have already consented to the disclosure or provision of such information. If the whereabouts of the individuals, juristic persons, or associated groups referred to in the preceding paragraph are unknown, the University shall publicize the content of the notice. If the concerned individuals, juristic persons, or groups referred to in Paragraph 2 of this Article fail to express their opinions within 10 days, the University may decide whether to provide the information on its own.
第十一條 本校核准提供校務資訊之申請時,得按校務資訊所在媒介物之型態給予申請人重製或複製品或提供申請人閱覽、抄錄或攝影。其涉及他人智慧財產權或難於執行者,得僅供閱覽。 申請提供之校務資訊已依法律規定或本辦法第五條第一款至第三款之方式主動公開者,學校得以告知查詢之方式,以代提供。 Article 11 Upon approving the provision of university affairs information, the University may, according to the medium in which the information is stored, offer copies or replicas in the same medium format to the applicant or offer them for reading, transcribing, or photographing the information. If such information involves intellectual property rights or information provision is difficult, only reading shall be allowed. In the event that the requested university affairs information has been publically disclosed according to laws or Subparagraphs 1–3, Article 5 of the Regulations, the University may inform the applicant of means of searching rather than providing the information.
第十二條 校務資訊內容關於個人、法人或團體之資料有錯誤或不完整者,該個人、法人或團體得申請本校依法更正或補充之。 前項情形,應填具申請書,除載明第九條第一項第一款、第二款及第五款規定之事項外,並載明下列事項: 一、申請更正或補充資訊之件名、件數及記載錯誤或不完整事項。 二、更正或補充之理由。 三、相關證明文件。 第一項之申請,得以書面通訊方式為之;其申請經電子簽章憑證機構認證後,得以電子傳遞方式為之。 Article 12 Individuals, juristic persons, or groups may request that the University correct wrong information or elaborate on incomplete university affairs information that concerns them according to the law. The correction or elaboration of information, as stated in the preceding paragraph, requires a completed application form specifying the matters stipulated in Subparagraphs 1, 2, and 5, Paragraph 1, Article 9 as well as the following items: 1. The name and number of cases filed for correction or supplementation, as well as the error or incomplete content that requires correction or supplementation. 2. Reasons for correction or supplementation. 3. Relevant identification materials. The application cited in Paragraph 1 may be done by mail or, if verified by an electronic certification authority, through electronic transmission.
第十三條 本校應於受理申請更正或補充校務資訊之日起三十日內,為准駁之決定;必要時,得予延長,延長之期間不得逾三十日。 第八條及第十條第二項至第四項之規定,於申請本校更正或補充校務資訊時,準用之。 Article 13 The University shall decide whether to correct or elaborate on the information within 30 days of accepting such an application. The period may be extended when necessary, but the extension shall not exceed 30 days. Paragraphs 2 to 4 of Articles 8 and 10 apply mutatis mutandis to cases where the University is requested to correct or further elaborate on university affairs information.
第十四條 本校核准提供、更正或補充校務資訊之申請時,除當場繳費取件或校務資訊之業務單位所提供之申請表件上已有規定者外,應以書面通知申請人提供之方式、時間、費用及繳納方法或更正、補充之結果。 前項應更正之資訊,如其內容不得或不宜刪除者,得以附記應更正內容之方式為之。 本校全部或部分駁回提供、更正或補充校務資訊之申請時,應以書面記明理由通知申請人。 申請人依第八條第二項或第十一條第三項規定以電子傳遞方式申請提供、更正或補充校務資訊或申請已註明電子傳遞地址者,第一項之核准通知,得以電子傳遞方式為之。 Article 14 After a request for the provision, modification, or elaboration of university affairs information has been confirmed, the University shall notify the applicant in writing of the provision method, time of provision, fee and payment method, and resolution regarding the correction or elaboration of the information, unless the applicant pays for and receives the materials on site or is otherwise stipulated on the application form by the information-providing unit. If the correction content in the preceding paragraph cannot or is not deemed suitable to be deleted, then the correction shall be written in the form of comments. When a request for the provision, correction, or elaboration of university affairs information has been partially or completely denied, the University shall notify the applicant in writing and specify the reasons. If the application for the provision, correction, or supplementation of information is made through electronic transmission according to Article 8, Paragraph 2 or Article 11, Paragraph 3, or the application included an e-mail address, then the approval notice in Paragraph 1 may be transmitted electronically.
第十五條 申請人對於本校就其申請提供、更正或補充校務資訊所為之決定不服者,得依法提起行政救濟。 Article 15 Applicants who are unsatisfied with the decision of the University with regard to the provision, correction, or elaboration of university affairs information may apply for an administrative remedy.
第十六條 本校依本辦法公開或提供校務資訊時,得按申請校務資訊之用途,向申請人收取費用;申請校務資訊供學術研究或公益用途者,其費用得予減免。 前項費用,依教育部訂頒之「教育部及所屬機關學校提供政府資訊收費標準」收費;未訂定收費標準者,由校務資訊提供之單位依校務資訊之檢索、審查、複製及重製所需之成本,決定所需收取之費用,簽奉核定後收取之。 Article 16 The university is entitled to charge a fee to applicants according to their requests for university affairs information. Such requests for the purpose of academic research or the public interest are associated with lower charges or are exempt from charges. The charges referred to in the preceding paragraph shall be designated in accordance with the Fee Standards for Government Information Requested From the Ministry of Education and Its Subordinate Institutions and Schools. Where no fee standard has been set, the fee shall be determined according to the costs incurred by the information-providing unit through searching, reviewing, copying, or reproducing the materials. The fee must be proposed for ratification before being charged.
第十七條 本辦法經校務會議通過後施行,修正時亦同。 Article 17 The Regulations, and any amendments to them, shall be implemented upon approval by the University Council.
