一、本要點依照「事業單位勞工退休準備金監督委員會組織準則」訂定之。

1. The directions were established in accordance with the Rules Governing Organization of Supervisory Committee of Business Entities’ Labor Retirement Reserve.

二、本要點所稱工友,係指本校編制內非生產性之技術工友﹝含駕駛﹞及普通工友。

2. The term “maintenance worker” mentioned in the directions refers to permanent technical workers (including chauffeurs) not involved in production activities and general maintenance workers of National Cheng Kung University (hereinafter “the University”).

三、本會定名為「國立成功大學工友退休準備金監督委員會」。

3. The committee shall be known as the National Cheng Kung University Supervisory Committee for Custodian Pensions.

四、本會會址設於台南市東區大學路一號國立成功大學總務處。

4. The address of the committee shall be set at the Office of General Affairs of National Cheng Kung University, No. 1, Daxue Rd., East Dist., Tainan City.

五、本會設委員九人由工友與校方代表組成之,其中工友代表人數不得少於六人。

5. The committee shall have nine members, consisting of maintenance workers and representatives of the University; the number of maintenance workers must not be less than six.

六、本會校方代表由總務長、主任祕書、主計室主任等三人兼任之。如職務變動則隨時改派兼任之。校方代表不克出席時,得指派職務代理人出席。

6. The University representatives on the committee shall concurrently be the vice president for general affairs, secretary general, and comptroller of the The Budget, Accounting and Statistics Office; these appointments may be switched to other personnel at any time if said positions are reassigned.

七、本會工友代表由工友直接選舉產生之。

7. The representatives of maintenance workers on the committee shall be directly elected by the maintenance workers.

八、本會工友代表之委員任期為三年,連選得連任,連任人數不得超過二分之一。依得票數高低定之。票數相同者抽籤決定之。工友代表因故出缺時,依得票數高低,依序遞補之,至任期屆滿為止。

8. The term of office for maintenance worker representatives on the committee is 3 years, and the representatives may be reappointed if they are elected again; however, reappointed representatives must not be more than half of all representatives. The representatives are appointed according to the number of votes each candidate receives; for two candidates with the same number of votes, a draw shall be performed. When a vacancy arises on the committee for any reason, the vacancy shall be filled by other candidates according to the number of votes they had received in the election, and the replacement shall serve until the end of the term.

九、本會置主任委員一人,綜理會務,由總務長兼任之;副主任委員一人,襄助主任委員處理會務,由工友代表互選產生之。

9. The committee shall have a chairperson who oversees all committee affairs, and the position shall be held by the vice president for general affairs. A vice chairperson who assists the chairperson in handling committee affairs shall be elected from among the maintenance worker representatives by themselves.

十、本會置職員三人,由主計室、出納組、事務組等三單位主管就業務相關人員指派兼任之。如承辦業務變動時則隨時改派兼任之。

10. The committee shall have three staff members who are appointed by the supervisors of the The Budget, Accounting and Statistics Office, Cashier Division, and General Service Division; university personnel in charge of relevant responsibilities shall assume those positions. The appointments shall be switched to other personnel any time that a change in responsibilities occurs.

十一、本會成立後,應即將成立日期及委員、職員名冊報請臺南市政府備查。委員、職員有變動時亦同。

11. Upon establishment, the committee must immediately submit the establishment date and the names of committee members and staff members to Tainan City Hall for future reference. The same shall apply to changes of committee members or staff members.

十二、本會委員、職員均為無給職。

12. Members and staff of the committee are not paid.

十三、本會之任務如左:

(一)關於工友退休準備金暫停提撥之審議事項。

(二)關於工友退休準備金提撥數額之查核事項。

(三)關於工友退休準備金存儲及支用之查核事項。

(四)關於工友退休金給付數額之查核事項。

(五)其他有關工友退休準備金之監督事項。

13. The functions of the committee are as follows:

(1) The examination of proposals for the temporary suspension of contributions to the maintenance worker retirement reserve fund.

(2) To verify and audit the contribution account of the maintenance worker retirement reserve fund.

(3) To verify and audit the deposit and the disbursement of funds to and from the maintenance worker retirement reserve fund.

(4) To verify and audit the amount of payment from the maintenance worker retirement reserve fund.

(5) Other supervision affairs in connection with the maintenance worker retirement reserve fund.

十四、本會每三個月舉行會議一次,必要時得召開臨時會議。會議主席由主任委員擔任之。主任委員因故不能出席時由副主任委員代理之。

14. A meeting shall be convened every 3 months; extraordinary meetings may be convened when deemed necessary. The meetings shall be convened by the chairperson of the committee. If the chairperson is unable to attend the meeting for any reason, the vice chairperson shall act on their behalf.

十五、本校工友退休依「勞動基準法」、「勞工退休金條例」及「工友管理要點」之規定辦理。

15. The retirement of maintenance workers from the University shall be processed according to the Labor Standards Act, Labor Pension Act, and Guidelines for the Management of Maintenance Workers.

十六、本會負責查核本校依工友每月薪資總額百分之二至百分之十五範圍內按月提撥之工友退休準備金,以及負責審核本校於每年年度終了一個月內造具工友退休準備金提撥及支出數額清冊。

16. The committee shall be in charge of auditing the University for contributing a sum within 2%–15% of the total monthly salaries of maintenance workers each month to the maintenance worker retirement reserve fund. The committee shall audit the list of contributions and expenses of the maintenance worker retirement reserve fund compiled by the University within 1 month of the end of a year.

十七、工友退休時,應由本校事務單位依照工友退休辦法規定,核計退休金,依行政程序經由校長及本委員會主任委員簽署,始得支付之。

17. When a maintenance worker is applying for retirement, the general affairs unit of the University shall calculate the pension according to the regulations concerning maintenance worker retirement and submit the results to the president and the committee in compliance with administrative procedures for approval before issuing any payment.

十八、本會因政府政策或本校決策廢除工友制度而解散時,其已提撥之工友退休準備金,用以支付工友退休金。如有賸餘時,其所有權屬於本校。

18. If the committee shall be dissolved due to the abolishment of maintenance worker employment by government policy or university decision, the contributed maintenance worker retirement reserve shall continue to be used to pay the pensions of maintenance workers. In the case that the reserve shall have any surplus, the University has the right to such amount.

十九、本要點未規定事項悉依勞動基準法及各相關法令辦理。

19. For other issues that the regulations fail to address, the Labor Standards Act and other relevant regulations shall apply.

二十、本要點經行政會議通過報請臺南市政府核備後施行,修訂時亦同。

20. The directions were approved at Administrative Meeting and filed for future reference at Tainan City Hall before implementation. The same process shall apply to all amendments.
