國立成功大學因應檢警調機關進入校園執法處理要點
National Cheng Kung University Handling Directives for Prosecution, Police and Investigation Organizations to Enforce Law and Enter the Campus

一、國立成功大學(以下簡稱本校)校園或教職員生發生疑似違法事件,基於學術自由與大學自治之精神,不妨礙檢警調機關公權力之行使,並兼顧本校教職員生權益之保護,特訂定本要點。

1. The directives are stipulated by National Cheng Kung University (hereinafter “the University”) in the spirit of academic freedom and university autonomy. In the event of suspected illegal incidents on campus or by students or staff, the University will not interfere with the exercise of public power of prosecution, police and investigation organizations, and will protect the rights and interests of the University staff and students.

二、本要點所稱檢警調機關,係指檢察機關、司法警察機關、調查局與廉政署等。

2. The prosecution, police and investigation organizations mentioned in the directives refer to the public prosecutor’s office, judicial police, Ministry of Justice Investigation Bureau and Agency against Corruption, etc.

三、檢警調機關進入校園之目的,分為下列三種:

(一)洽辦公務。

(二)請求協助提供偵辦案件所需資料。

(三)偵辦刑事案件。

3. There are three purposes for prosecution, police and investigation organizations to enter the campus:

(1)Conduct official business

(2)Request assistance in providing information needed to investigate the case

(3)Investigate and handle criminal cases

四、檢警調機關進入校園如為洽辦公務,且經校區門崗確認身分及洽辦事項,依本校校外人士入校洽公相關規定辦理。

4. If the prosecution, police and investigation organizations enter the campus for official business, and the campus security staff confirms the identity and the official business, the relevant regulations for people from outside the University to enter the University shall apply.

五、檢警調機關進入校園如為請求本校協助提供偵辦案件所需監視錄影資料,其程序如下:

(一)各單位應通知校安中心(設於軍訓室,分機:55555),由校安中心值班人員通報監視錄影系統管理單位,經管理單位主管同意後,提供所需資料,並通報主任秘書。

(二)檢警調機關人員調閱或複製影音資料時,應由管理單位派員陪同並協助辦理。

5.If the prosecution, police and investigation organizations enter the campus to request the University’s assistance in providing surveillance video for case investigation, the procedures are as follows:

(1)Each unit should notify Campus Security Center (located in the Military Training Division, extension: 55555). The staff on duty of Campus Security Center shall inform the management unit of the surveillance video system, and shall provide the required materials and notify the Secretary General after the approval of the supervisor of the management unit.

(2)Personnel of the prosecution, police and investigation organizations shall be accompanied and assisted by the management unit when accessing or copying audio and video materials.

六、檢警調機關進入校園如為偵辦校園或本校教職員生涉及之刑事案件,其程序如下:

(一)檢警調機關人員須出示相關證明文件,如服務證、搜索票或拘票等,由各校區門崗(各單位)人員驗證後通報校安中心,再由校安中心通報主任秘書,並由主任秘書指定本校代表人員陪同進行。

(二)檢警調機關人員對於涉案嫌疑人執行搜索、逮捕或拘提時,校安中心及所屬單位派員陪同。

(三)檢警調機關人員現場查扣之證物資料,如屬本校所有、持有或保管者,查扣單位應交付扣押物收據。

6. If the prosecution, police and investigation organizations enter the campus for the purpose of investigating criminal cases on campus or involving its staff or students, the procedures are as follows:

(1)Personnel of the prosecution, police and investigation organizations shall present relevant supporting documents, such as service card, search ticket or arrest warrant, which shall be verified by the security staff of each campus (each unit) and reported to the Campus Security Center, and then to the Secretary General of the Campus Security Center. The Secretary General will designate a representative of the University to accompany them.

(2)When the personnel of the prosecution, police and investigation organizations search for, arrest or detain the suspects involved, the staff of Campus Security Center and the respective units will accompany them.

(3)If the University owns, holds or has custody of the evidence seized by the personnel of the prosecution, police and investigation organizations, the seizure unit shall provide a receipt for the seized material.

七、本校人員因執行業務所知悉之事項,應予保密,不得洩漏,並恪遵偵查不公開原則。

7. Matters known to the staff of the University in the course of their business shall be kept confidential and the principle of non-disclosure shall be observed.

八、本要點經主管會報通過後實施,修正時亦同。

8.The directives shall be implemented after being submitted and approved by the Supervisory Meeting.
