一、依據本校組織規程第二十四條訂定之。

I.  These Directions are formulated in accordance with Article 24 of the Organizational Regulations of National Cheng Kung University.

 

二、為求公平、公正討論及決議有關學生獎懲重大事項,以確保學生合法權益,特設學生獎懲委員會(以下簡稱本會)。

II.  The Student Rewards and Disciplinary Committee (hereinafter the Committee) is established to impartially discuss and resolve major student cases concerning considerable rewards and disciplinary actions to safeguard the rights and interests of students.

 

三、本會由下列人員組成之:

(一)當然委員:學生事務長(會議主席)及教務長。

(二)教師委員:由各學院推薦助理教授以上二名。

(三)專業委員:由法律系推薦助理教授以上教師一名、心理健康與諮商輔導組推薦心理師或助理教授以上心理輔導教師一名。

(四)學生委員:依本校「各級會議學生代表遴選委員會設置辦法」推選大學部代表二人及研究所代表二人,共四人。

本會之組成,任一性別委員應占委員總數三分之一以上。

各學院應推薦助理教授以上一名擔任候補委員。

大學部及研究所之學生委員應各推選學生一名擔任候補委員。

III.  The Committee consists of the following members:

(I) Ex officio members: Vice President for Student Affairs (chair of meeting) and Vice President for Academic Affairs.

    (II) Faculty representatives: Two faculty members recommended by each college from the

faculty of professors.

(III) Professional representatives: One professor (assistant professor or above) recommended by the Department of Law, and a psychological counselor or a professor (assistant professor or above) recommended by the Student Counseling Division.

(IV) Student representatives: A total of four representatives, including two undergraduate students and two graduate students, elected according to NCKU Regulations for the Establishment of the Committee for the Election of Student Representatives to Meetings at Different Levels.

The Committee shall consist of more than one-third of members of either gender.

Each college shall recommend an assistant professor or above as an alternate member.

One undergraduate student and one graduate student shall be elected as alternate members.

 

四、本會委員於每學年開學後一個月內由校長完成聘任,任期一年,得連任之。

IV. The members of the Committee shall be appointed by the President of the University within one month from the beginning of each academic year. Every member shall serve a term of one year and is then entitled to reappointment.

 

五、本會僅審理學生在校大功、大過以上之獎懲案件。

V. The Committee functions to review major student cases involving major-merit rewards or major-demerit punishments.

 

六、本會不定期召集之,經全體委員二分之一以上出席,始得開會,經出席委員三分之二以上同意,始得決議。

本會討論議案如未獲出席委員三分之二以上同意時,得由主席、獎懲委員、原提報單位或被提報學生另作一處分建議,經出席委員附議後,重新表決。

本會委員應親自出席會議,除當然委員得指派或委託他人代理外,教師委員及學生委員如因故不克出席,得由所屬單位推薦之候補委員遞補出席。

VI.  The Committee shall not meet regularly, but instead whenever necessary. A meeting of the Committee shall not commence without a quorum of half of its members. A resolution shall not be reached without the consent of more than two-thirds of the members in attendance.

If a resolution fails to receive the consent of more than two-thirds of the members in attendance, the Committee chair, Committee member, the office concerned, or the student concerned may propose another resolution, if seconded, for a vote.

Committee members shall attend meetings in person, except ex officio members who may appoint their deputies. In the event that a faculty or student representative is unable to attend a Committee meeting, the designated alternate member shall attend the meeting.

 

七、本會於收到學生大功或大過以上獎懲之提案時,必要時得由學生事務長邀請具法律或相關背景之教師委員、專業委員及學生委員等各一人共三人,組成預審小組,召開預審會議。

預審會議得審查下列事項:

(一)提案是否符合本校學生獎懲要點規定。

(二)獎懲之事實及理由。

(三)通知列席會議之關係人。

(四)請獎懲提報單位,必要時連同關係人,答復獎懲之內容與事證。

(五)安排準備獎懲會議之其他相關事項。

預審會議所為之預審事項,得交由學生事務處生活輔導組承辦其中所列相關事項為程序審查,並應就審查事項列明書面紀錄且陳報本會決議。

VII. Upon receipt of any student cases involving major-merit rewards or major-demerit punishments, the Committee shall entitle the Vice President for Student Affairs, whenever necessary, to invite one faculty representative, one professional representative and one student representative in the field of law or with the related background to form a preliminary review panel and call a preliminary review meeting. The panel shall function as follows:

(I) To review if the case is proposed in accordance with the NCKU Directions for

Student Rewards and Penalties.

(II) To review the facts and reasons cited for the reward or penalty.

(III) To notify the parties concerned of meeting attendance.

(IV) To invite the responsible office and, if necessary, the party concerned to report the contents and evidence of the proposed reward or penalty.

(V) To make necessary preparations for a Committee meeting scheduled for the proposed case.

The panel shall assign the Student Assistance Division under the Office of Student Affairs to handle procedural reviews and administrative matters to facilitate its meeting and submit its meeting minutes to the Committee for a resolution.

 

八、本會開會時,得請有關人員及當事人員列席說明。

VIII. The Committee is entitled to invite relevant personnel to deliver a report in its meeting.

 

九、依據本會決議由學生事務處生活輔導組於十日內簽請獎懲,經校長核准,學生事務處公告。當事人如有不服,得依本校「學生申訴評議委員會設置與申訴處理辦法」之規定,提起申訴。

IX. Upon receipt of a resolution of the Committee, the Student Assistance Division under the Office of Student Affairs shall have a report of reward/punishment submitted and confirmed by the President within ten days. The notice of reward/punishment shall be publicized by the Office of Student Affairs. The party concerned is entitled to file an appeal against the resolution according to National Cheng Kung University Regulations Governing the Establishment and Administration of the Student Appeals Review Committee.

 

十、本要點經學生事務會議及行政會議通過後實施,修正時亦同。

X. These Directions shall be approved by the Student Affairs Council and the related administrative meeting before taking effect. Any amendments shall be processed accordingly.
