約聘教師契約書
NCKU Miin Wu School of Computing
Agreement for Contract Faculty Members
國立成功大學(甲方)敏求智慧運算學院(以下簡稱本院)為應院務需要,聘任__________為教授(以下簡稱乙方),經雙方同意訂立契約,共同遵守約定條款如下:
Miin Wu School of Computing (hereinafter referred to as the "School"), National Cheng Kung University ("Party A") appoints as a professor (hereinafter referred to as "Party B") for certain affairs of the School. Both parties agree to enter into this agreement under the terms and conditions set out below:
一、聘任期間:自____年____月____日起至____年____月____日止。
1. Term of employment: From (MM/DD/YY) to (MM/DD/YY).
二、工作內容:依本院教師評審委員會聘任案決議內容。
2. Duties and responsibilities: Subject to the resolution on such employment announced by the Faculty Evaluation Committee of the School.
三、薪資:每月新台幣____萬元整。
3. Remuneration: NT$____0,000 per month.
四、授課時數:依進用計畫書內容辦理。
4. Teaching hours: as specified in the project proposal.
五、到職及離職:乙方接到甲方聘任通知後,應依規定辦理到職手續。聘期屆滿如未獲續聘,乙方即須離職,不得異議。乙方如因特別事故須於聘約期滿前先行離職時,應於一個月前提出申請,經甲方同意後始得離職。乙方離職時,應依規定辦妥離職手續後始得離職。
5. Arrival and resignation: After receiving the offer letter from Party A, Party B shall report for duty according to regulations. If the term of employment is not renewed upon expiration, Party B must resign immediately with no right to object. For special circumstances where Party B is forced to resign before the term of employment expires, he/she must apply for approval from Party A one (1) month in advance. Party B must complete all the resignation procedures to officially leave the post according to regulations.
六、差假與出國:比照甲方約聘教師相關規定,特殊情況得簽請校長核准,如屬加密文件,加密處理。
6. Travel, leave and going abroad: Subject to Party A's regulations for contract faculty members; any special cases shall be reported to the President for approval; if an encrypted file is involved, encryption shall be executed.
七、乙方經本校書面同意後,得於校內外兼課或兼職,惟不得影響於本院之工作,特殊情況得簽請校長核准。
7. Party B may receive part-time employments or teaching positions outside or inside the NCKU upon the written permission of the NCKU, which, however, should not affect Party B's duties and responsibilities in the School. Any special cases shall be reported to the President for approval.
八、保險:乙方如符合「勞工保險條例」及「全民健康保險法」之被保險人資格者,應於到職時,由甲方辦理加保手續;聘約期滿或中途離職,應辦理退保。未具參加勞工保險或全民健康保險投保資格者,可請甲方協助辦理「國際技術合作人員綜合保險」。保險費由乙方負擔35%,甲方負擔65%。如乙方不擬參加此項保險,應以書面親筆簽名向甲方聲明。
8. Insurance: If Party B is eligible for the insured as set forth in the Labor Insurance Act and the National Health Insurance Act, Party A shall enroll him/her in the insurance program upon Party B arriving at the post. Party B shall withdraw from insurance coverage when the term of employment expires or upon resignation. If Party B is ineligible for such labor insurance or national health insurance program, Party B may request for Party A's assistance in enrolling him/her in the "Omnibus Insurance Program for International Technical Cooperation Personnel", where Party B and Party A are responsible for 35% and 65% of the insurance premium respectively. If Party B does not wish to enroll in such insurance program, he/she shall submit a written declaration (signed in person) to Party A.
九、退休:甲方參照勞工退休金條例為乙方提繳勞工退休金(外國籍人士比照各機關學校聘僱人員離職儲金給與辦法提撥離職儲金)並處理相關退休事宜。上述乙方自願提繳勞工退休金(離職儲金)之費用,由甲方於發放薪資中代為扣繳。
9. Retirement: According to the Labor Pension Act, Party A must contribute part of Party B’s monthly wage to an individual pension account (contribution benefits are applicable for foreign personnel and shall be handled in accordance with the Regulations for Separation Fund Payment for Government Organization or School Employees) for retirement compensation. The aforementioned voluntarily contribution from Party B for labor pension or contribution benefits will be deducted by Party A from his/her salary.
十、福利:以甲方約聘教師契約書規定為原則辦理,另包含
(一)房租補助費用:每人每月新台幣一萬五千元(初聘前三年)。
(二)其他經專案簽准之福利事項。
10. Benefits: Any benefits will be granted as per the Agreement for Contract Faculty Members, additionally including:
(1) Rent subsidies: NT$ 15,000 (fifteen thousand) /person/month (within the first three years of the term of initial employment); and
(2) Other benefits to be granted after special cases are approved.
十一、乙方年終工作獎金比照甲方編制內專任教師。
11. Party B's year-end work bonus will be equivalent to that of Party A's full-time faculty members within the establishment of Party A.
十二、乙方茲聲明無以下情事;如有隱匿經甲方查證屬實,甲方得立即以書面終止本契約:
(一)乙方於受聘前犯性侵害犯罪防治法第二條第一項之性侵害犯罪,經有罪判決確定。
(二)乙方於受聘前有性侵害、性騷擾或性霸凌之行為,經認定不得擔任教育從業人員,且於受聘時尚處該管制期間內。
12. Party B hereby declares that neither of the following applies to him/her; Party A may immediately terminate this agreement in writing should Party B’s declaration be found to be false:
(1) Having committed and been convicted of any sexual assault crime as stipulated in Paragraph 1 of Article 2 under the Sexual Assault Crime Prevention Act before this employment; or
(2) Having committed sexual assault, sexual harassment, or sexual bullying before this employment, for which he/she is still banned from being reappointed as an educational practitioner.
十三、甲方為確認乙方是否有前條所定情事,乙方同意甲方得依教育部「學校辦理契約進用人員通報查詢作業注意事項」,向各級主管教育行政機關辦理其相關資訊之蒐集、處理、利用、查詢,並同意法務部、警政機關及各級主管教育行政機關向甲方提供其相關資訊。
13. To confirm the declaration made by Party B in the preceding article, Party B agrees that: i) Party A is allowed to request any information for collection, treatment, utilization, and inquiries from each level of educational administrative department in accordance with the Directions for Reporting and Inquiry Mechanisms for Universities Recruiting Contracted Employees promulgated by the Ministry of Education (MOE); and ii) the Ministry of Justice, police authorities, and each level of educational administrative department should provide Party A with relevant information.
十四、乙方於受聘期間如有涉及性侵害、性騷擾或性霸凌行為之情事,甲方得於性別平等教育委員會受理調查之日起1個月內召開校教評會審議通過後,先行停止本契約之執行,乙方應配合調查並靜候結果。停止本契約執行期間,乙方同意甲方得停止支付全部薪資。
甲方應於知悉之日起2個月內完成調查。必要時,得延長之,延長以2次為限,每次不得逾1個月,並應通知乙方。視調查結果認定有無第一項所述情事,後續薪資給付處置程序如下:
(一)經調查屬實者,甲方得立即以書面終止契約,且乙方不得要求補發停止契約執行期間薪資。
(二)經調查無此事實者,甲方應於1個月內補發停止契約執行期間之全部薪資,乙方同意不為其他補償之請求。
14. Should Party B engage in sexual assault, sexual harassment, or sexual bullying during his/her period of employment, Party A may hold a Faculty Evaluation Committee meeting within one (1) month after the Gender Equity Education Committee undertakes an investigation. Upon approval through the meeting, Party A may suspend the performance of this agreement. Party B shall cooperate with the investigation and await its results. If the performance of this agreement is suspended, Party B agrees that Party A is not responsible for salary payment.
Party A shall complete its investigation within two (2) months after knowing the offense. If necessary, this period may be extended a maximum of two (2) times; each extension shall not exceed one (1) month, and Party B must be notified. Investigation results shall determine whether Party B has committed any offense mentioned in Paragraph 1, according to which subsequent salary payments shall be handled as follows:
(1) If an offense was confirmed, Party A may immediately terminate this agreement in writing, and Party B may not request any salary lost during the period when the performance of this agreement has been suspended; or
(2) If no offense was committed, Party A shall repay within one (1) month the full salary lost during the period when the performance of this agreement has been suspended. Party B agrees not to request other compensation.
十五、乙方如有第十二條或前條第三項第一款所定情事,乙方同意甲方向各級主管教育行政機關辦理其相關資訊之通報、處理及利用,並同意法務部、警政機關及各級主管教育行政機關提供相關資訊;乙方離職後始經查證屬實者,亦同。
甲方依前項約定辦理通報後,乙方不得要求刪除、停止處理或利用其個人資料。
15. Should Party B be involved in any offense mentioned in Article 12 or Subparagraph 1, Paragraph 3 of the previous article, Party B agrees that: i) Party A has the right to request any information for collection, treatment, utilization, and inquiries from each level of educational administrative department; and ii) the Ministry of Justice, police authorities, and each level of educational administrative department may provide Party A with relevant information. The same applies when such an offense is confirmed after Party B’s resignation.
After Party A has filed a report according to the agreement in the preceding paragraph, Party B may not request that Party A deletes or terminates the treatment or use of his/her personal data.
十六、乙方於執行教學、指導、訓練、評鑑、管理、輔導或提供學生工作機會時,在與性或性別有關之人際互動上,不得發展有違專業倫理之關係。乙方發現師生關係有違反前項專業倫理之虞,應主動迴避或陳報學校處理。
乙方應尊重他人與自己之性或身體之自主,避免不受歡迎之追求行為,並不得以強制或暴力手段處理與性或性別有關之衝突。除上開規定外,乙方應遵守性別平等教育法及性別工作平等法等相關法令規定。
16. When Party B is teaching, mentoring, or training; performing appraisals, management, or counseling; providing students with work opportunities; or participating in a research project with students, he/she is not allowed to engage in sex- or gender-based interpersonal interactions that violate professional ethics. Should
Party B identify a possibility of such a relationship with students during research, implementation of research projects, or teaching, he/she shall avoid such an interaction or report it to the university.
Party B shall respect the sexual or physical autonomy of others and themselves as well as avoid inappropriate romantic pursuits. Party B is not allowed to resort to compulsory or violent means when handling sex- or gender-related conflicts. In addition to the aforementioned provisions, Party B must comply with the Gender Equity Education Act, the Act of Gender Equality in Employment, and other related laws.
十七、乙方在約聘期間不適用「教師法」、「國立成功大學教師借調處理要點」、「國立成功大學教師出國講學及國內外研究進修申請作業要點」、「國立成功大學教授、副教授休假研究辦法」、「學校教職員退休、撫卹條例」及公教人員婚、喪、生育、子女教育補助等相關規定。
17. Party B’s employment is not subject to regulations such as the Teachers’ Act, the National Cheng Kung University Implementation Directions for Job Rotation Among Teachers, the National Cheng Kung University Guidelines for Applying for Lecturing Abroad, Domestic and Overseas Research, and Advanced Study, the National Cheng Kung University Regulations on Sabbatical Leave for Professors and Associate Professors, the Act Governing Retirement, Severance, and Bereavement Compensation for Teaching and Other Staff of Public Schools, as well as civil servant subsidies for marriages, funerals, births, and children’s education.
十八、乙方於聘約有效期間,如違反契約應履行義務,或有其他不當行為,經本院約聘教師評審委員會決議,甲方得終止本契約並予解聘;除扣償溢領之酬金外,如有損害並追償違約之損害賠償。
18. During the valid agreement term, if Party B has committed a violation because of a breach of contract caused by failure to perform obligations, or other misconduct, upon approval through resolution by the Contract Faculty Members Evaluation Committee of the School, Party A may terminate this agreement and dismiss Party B. In addition to returning overpaid remuneration, Party B may be requested to compensate for damages incurred because of the breach of this agreement.
十九、甲方於計畫執行期限內如因故計畫停止,本契約亦應同時終止。
19. If Party A terminates the research project for any reason during the project implementation period, this agreement shall be terminated concurrently.
二十、本契約如有未盡事宜,依本校相關法令規定辦理。
20. Matters not covered herein shall be handled in accordance with relevant regulations of the university.
二十一、甲乙雙方因本契約發生訴訟時,同意以甲方所在地之管轄法院為第一審管轄法院。
21. Both parties agree to designate the governing court at Party A’s location as the competent court of first instance if a lawsuit arises because of this agreement.
二十二、本契約書一式三份,甲方(人事室)、本院及乙方各執一份。
22. This agreement is made in triplicate, with Party A (Personnel Office), the School, and Party B holding one (1) copy each.
※附註:
1. 本契約書須俟與旺宏電子股份有限公司之捐贈契約生效且捐贈款入帳後,始生效,甲方如經費不足時,本契約應同時終止。
2. 乙方之前如曾因他案與本校簽訂聘任契約書,其聘期與本契約聘期重疊時,前契約書在本契約書生效時同時終止。
3. 本契約書制式內容經本校教評會審議通過後實施,修正時亦同,不得擅自更動,如被更動,該更動條款視為無效。
* Notes:
1. This agreement will not become effective until the contract for donation concluded with Macronix International Co., Ltd. comes into effect and the donation is credited into the account. If Party A's funds are insufficient, this agreement shall be terminated concurrently.
2. If Party B has previously signed another employment contract with the university and its employment period overlaps with this agreement, the previous contract shall be terminated when this agreement becomes effective.
3. The standard content of this agreement is deemed effective upon review and approval by the Faculty Evaluation Committee of the university. The same shall apply to the revisions. Any amendment to the standard content without permission is not allowed. Any modified provision is considered invalid.
