第一條

國立成功大學(以下簡稱本校)學生事務處(以下簡稱本處)依據本校組織規程第三十二條、本校各學系(所)教師評審委員會設置辦法及相關法令規定,設置本校學生事務處教師評審委員會(以下簡稱本會),並訂定本辦法。

 

Article 1

In accordance with Article 32 of the Organizational Regulations of National Cheng Kung University, the NCKU Regulations for the Establishment of Department and Institute Faculty Evaluation Committees, and relevant laws and regulations, the Office of Student Affairs (hereafter the Office) at National Cheng Kung University (NCKU) has established its Faculty Evaluation Committee (hereafter the Committee) with these regulations.

 

第二條

本會置委員七至九人,由下列人員組成之:

一、當然委員:學生事務長(兼召集人),召集人因故無法主持或遇有迴避情形時,其代理主席之產生,由本會委員共推之。

二、推選委員:由學務主管會議自本處專任教授推選之,已同時擔任院、校級教評會委員者,不得再擔任之。如本處符合推選委員遴選資格之專任教授未達應推選總數時,得由學務主管會議自校內外選聘專長相近之教授或本處專任副教授擔任,但教授之人數不得少於三分之二。委員任期一年,連選得連任。

教師於奉准借調、休假研究、全時進修研究、出國講學或留職停薪期間,不得擔任本會委員。

本會推選委員在任期中出缺,由候補委員遞補後不足時,另行推選委員遞補,其任期以補足所遺任期為限。

 

Article 2

The Committee shall consist of seven to nine members, including the following personnel:

1.     Ex officio member: The Vice President of Student Affairs is an ex office member and the convener of the Committee. If the convener is unable to chair a Committee meeting or must make a recusal from a Committee meeting, an acting chair shall be elected from among Committee members.

2.     Elected members: The other members shall be full-time full professors of the Office elected by the Student Affairs Chief Administrators Council (hereafter the Council). However, a professor who serves concurrently as a member of the Faculty Evaluation Committee at the levels of college and university shall not be appointed to the Committee. If the number of full-time full professors in the Office eligible for member election is short of the required quota, full-time full professors with equivalent expertises from within or outside of NCKU or associate professors of the Office may be elected by the Council to the Committee, with a minimum two-thirds of members being full professors.

Committee members shall serve a term of one year and be eligible for reelection.

Professors shall not serve as members of the Committee during the period of approved secondment, sabbatical leave, full-time advanced study, overseas lecture, or unpaid leave.

If the position of an elected member becomes vacant during the term of office, an alternate member shall fill up the vacancy for the remaining term of office. When necessary, additional alternate members shall be elected to meet the required quota.

 

第三條

本會審議下列事項:

一、專任教師(含約聘教師)之聘任、聘期、升等、解聘、停聘、不續聘、資遣原因之認定等事項。

二、教官參與教學相關事項。

三、其他有關教師評審之重要事項及有關規定需由本會審議之事項。

 

Artice 3

The Committee functions to review the following matters:

1.   Employment of fulltime faculty members (including adjunct faculty members), with regard to employment, employment period, promotion, dismissal, suspended employment, discontinued employment, or ratification of reasons for severance.

2.   Participation of military instructors in teaching activities.

3.   Other major matters and regulations relating to the Office faculty evaluation.

 

第四條

本會每學期開會一次為原則,必要時得召開臨時會議。

 

Article 4

In principle, the Committee will hold one meeting every semester, although if necessary an extraordinary meeting will be convened.

 

第五條

教師之升等,由本會依本處教師升等初審辦法審查通過後,向非屬學院教師評審委員會推薦。本處教師升等初審辦法另訂之。

其他教師評審重要事宜,由本會依本處發展需要及相關規定審查,通過後依相關規定辦理。

 

Article 5

Upon approval by the Committee in its preliminary review in accordance with the Office Regulations for Faculty Promotion, an application for faculty promotion will be submitted to the Non-academic College Faculty Evaluation Committee for a secondary review. The Office Regulations for Faculty Promotion shall be established in a separate text.

Other important matters related to faculty evaluation shall be reviewed by the Committee based on the needs for the development of the Office and relevant regulations. Once approved, they will be administered in accordance with relevant regulations.

 

第六條

本會開會時,除教師法或專科以上學校兼任教師聘任辦法另有規定外,應有委員三分之二以上之出席及出席委員三分之二以上之同意,始得審議通過。

本會委員有應行迴避之情事者,決議時不計入出席委員人數。

本會得視需要由召集人邀請有關人員列席報告或說明。

 

Article 6

 

Unless otherwise specified in the Teachers’ Act and the Regulations Governing the Employment of Part-time Teachers in Tertiary Education Institutions, a meeting of the Committee shall be called with a quorum of more than two-thirds of Committee members in attendance. A meeting shall not reach any resolution that fails to pass with a quorum of more than two-thirds of attending members.

Committee members who should make a recusal shall not count as part of the attending members in time of a resolution.

Should need arise, the convener may invite the parties concerned to attend a Committee meeting to present a report.

 

第七條

本會委員審議案件時,有下列各款情事之一者,應自行迴避:

一、本人或其配偶、四親等內之血親或三親等內之姻親或曾有此關係,為當事人者。

二、與當事人曾有指導博士、碩士學位論文之師生關係者(學位論文指導教授)。

三、其他本人與當事人間有利害關係,經本會決議應予迴避。

本會委員審議案件認有前項以外之特殊事由應迴避時,得向本會申請迴避。

有具體事實足認本會委員就審議案件有偏頗之虞者,當事人得舉其原因事實向本會申請該委員迴避。

前二項申請,由本會決議之;本會認為委員有應迴避之事由,而未自行迴避或申請迴避者,亦同。

本會委員擔任兩級教評會委員,對同一審議案,依迴避原則處理,只得於本會中投票,因故未出席本會者,方得於後一級教評會投票。但該審議案須該委員說明者,本會得請該委員說明之。

 

Article 7

 

A Committee member should file a recusal from a review meeting under one of the following circumstances:

1.     A Committee member who is an applicant under review, a spouse or ex spouse of an applicant under review, who is related to an applicant under review by blood within the fourth degree of relationship or by marriage within the third degree of relationship, or who is involved in a conflict of interests with an applicant under review should make a recusal from the review of the application. The Committee shall formally exempt a recused member from the review process.

2.     A Committee member who was a master’s thesis or doctoral dissertation advisor to the applicant under review.

3.     A Committee member who is an interested party to the applicant under review shall make a recusal from the review upon resolution of the Committee.

Under special circumstances that are not specified in the preceding rule, a Committee member may apply to the Committee to recuse himself/herself from any relevant review process.

An applicant under review who considers a Committee member likely to be prejudiced to him or her may apply to the Committee with solid evidence to exclude the member in question from the case concerned.

Applications specified in the preceding two paragraphs shall be decided by the Committee. The same shall apply in the case where the Committee considers that a Committee member should make a recusal but fails to do so or apply for recusal.

A Committee member who serves as a member on faculty evaluation committees at two levels should review the same case based on the principle of recusal. S/he can only vote on the case in the Committee. Only when s/he fails to attend the Committee for some reason can s/he vote in the upper-level faculty evaluation committee. However, if the review case requires the member to submit an explanation, the Committee may ask the member to do so.

 

第八條

本辦法經本處學務主管會議通過,報請非屬學院核轉校教師評審委員會核備後施行,修正時亦同。

 

Article 8

These Regulations shall be approved by the Student Affairs Chief Administrators Council and submitted by the Non-academic College to the NCKU Faculty Evaluation Committee for ratification before taking effect. Amendments shall be processed accordingly.
