第 一條                   

國立成功大學(以下簡稱本校)研究發展處儀器設備中心(以下簡稱本中心)為推動、執行本校儀器、設備共用與管理,特制定本辦法。

Article 1             

These regulations are formulated for the Instrument Development Center of the Office of Research and Development (this center) at the National Cheng Kung University (our university) to manage and share instruments and facilities possessed by this university.

 

第二條               

本辦法所稱儀器、設備,係指依國立成功大學儀器設備補助審查辦法第七條,以本校補助配合款所購置在研究上具有重要性、共用性,或需具特殊專長之技術人員操作,其金額逾新臺幣參佰萬元以上的儀器、設備。

Article 2             

The instruments and devices denoted in these regulations refer to those purchased by this university with the matching funds in accordance with Article 7 of the National Cheng Kung University Examination Rules for Instrument and Facility Subsidy. Such instruments and devices are essential for research purposes, can be shared by multiple units, must be operated by technicians with special expertise, or cost NT$3 million or above.

 

第三條                   

為執行本辦法,設置「國立成功大學共用儀器設備管理委員會」(以下簡稱本委員會)。本委員會由研發長擔任召集人,委員13至17人,任期兩年,期滿得續任之。除本中心主任為當然委員外,其餘委員由各學院及研發長推薦,由研發長提請校長聘任之。

Article 3                 

To enforce these regulations, the NCKU Committee for the Management of Shared Instruments and Facilities (this Committee) was established. The Chief R&D Officer serves as the convener of this Committee, which consists of 13–17 members. The term of office for these committee members is 2 years, and they may be reappointed at the end of their term. The director of this center serves as the apparent committee member, whereas the remaining committee members are recommended by each college and the Chief R&D Officer, nominated by the Chief R&D Officer, and appointed by the President.

 

第四條               

本委員會協助本中心執行以下任務:

一、審核本中心發展方針、工作計畫及執行績效。

二、審核各項儀器、設備之汰換,以及設置地點變更。

三、審核共用儀器、設備之申請加入。

四、審核各項儀器、設備之收費標準。

五、審核本中心編制內及編制外工作人員考核、獎勵及工作輪調等事項。

六、其他有關儀器、設備之共用事宜。

Article 4             

This Committee assists this center in performing the following tasks:

1. To review the development directions, work plans, and execution performance of this center.

2. To review the replacement of various instruments and facilities as well as changes in their installation locations.

3. To review applications for adding new items to shared-use instruments and facilities.

4. To review the charging standards of each instrument and facility.

5. To conduct performance appraisal of, present rewards to, and mnanage the job rotation of the official and contracted staff employed in this center.

6. Other affairs related to instrument and facility sharing.

 

第五條               

本辦法之儀器、設備,以設置在本中心儀器大樓為原則,並以本中心為管理單位,但情形特殊經本委員會核可者,不在此限。

本校各單位所經管非屬第二條規定之儀器、設備,亦得向本中心提出申請後,加入共同使用。

Article 5             

Instruments and facilities governed by these regulations should be installed in the instrument building of this center and managed by this center. However, special cases that have obtained approval from this Committee can be exempted from this rule.

Instruments and facilities not governed by Article 2 and managed by other units of this university can be incorporated into the sharing network after an application is submitted to and approved by this center

 

第六條               

為提升研發能量及降低儀器、設備維修成本,本中心得將相同儀器、設備進行統合規劃、維修,並建立儀器專家資料庫,以為諮詢之參考。

Article 6                 

To enhance the R&D capacity and lower instrument and facility maintenance cost, this center can conduct the integrative planning and maintenance of identical instruments and facilities. An instrument expert database can also be built to serve as a reference when needed.

 

第七條               

本中心得提供各儀器、設備之使用狀況,作為本校未來儀器、設備採購或汰換之參考。

Article 7             

This center reports the usage conditions of all instruments and facilities to the university to serve as a reference in the future procurement and replacement of instruments and facilities.

 

第八條               

本中心就各項儀器、設備得酌收使用費,使用費可以現金或轉帳方式繳交,校內使用單位繳交之使用費學校不重複收取管理費,所收取之使用費依本中心20%,主持人或所屬單位80%之原則分配,校外使用單位繳交之使用費扣除管理費後,餘額依本中心20%,主持人或所屬單位80%之原則分配;儀器使用費另定之,並由本委員會核定後實施。

前項分配中心使用費,作為中心行政運作費及推動共用設備相關業務。分配給主持人或所屬單位之使用費,則作為該儀器運作、維護、管理、耗材等相關業務所需專款。

Article 8                 

This center can charge a usage fee for each instrument and facility. The usage fee can be paid in cash or via transfer. This university shall not charge its affiliated units an administration fee on top of the usage fee. The usage fees thus collected will be allocated by the proportion of 20% to this center and 80% to the principal investigator or the corresponding unit. For the usage fees collected from external users unaffiliated to this university, an administration fee will be deducted first, and the remaining amount of money will be allocated by the proportion of 20% to this center and 80% to the principal investigator or the corresponding unit. The instruments’ usage fees will be otherwise set and enforced after obtaining approval from this Committee.

The usage fee allocated to this center in the previous paragraph will be used to support its administrative operations and affairs related to the promotion of facility sharing. The usage fee allocated to the principal investigator or the corresponding unit will be used as a special fund to facilitate the operation, maintenance, management, and consumable replacement of the shared-use instrument.

 

第九條               

加入本辦法之共同使用儀器在第八條所規範之80%儀器使用費不足支付儀器運作維修等相關費用時,在儀器設備使用費用完後,得向本中心提出輔助費用之申請。本中心得視經費許可及諸儀器執行與管理之績效,由本委員會審定其儀器服務狀況及需求之合理性,向本中心推薦。本中心核准之補助經費,其支用、核銷等,悉依本中心規定辦理。

Article 9                 

For instruments that joined the sharing network governed by these regulations, in cases where the 80% of the instrument usage fee stipulated in Article 8 is insufficient to pay the instrument operation or maintenance fees, an application may be filed to this center for extra subsidies when the instrument or facility usage fee has been used up. This center will review the subsidy application on the basis of fund availability and the execution and management performance of the shared-use instruments. This Committee may recommend an appropriate subsidy amount after reviewing the service status of the shared-use instruments and the legitimacy of the demand. The payment and write-offs of the subsidies granted by this center will be performed in accordance with the regulations.

 

第十條               

本校各單位教師、研究人員有使用本中心儀器、設備之需要時,可通過本中心網頁提出預約申請。本中心在不影響本校各單位或教師之使用下,亦得開放全部或一部份儀器、設備供校外人士使用,並依審定之收費標準收費。

Article 10           

Faculty members and research staff of various units of this university can make reservations online when the need arises to use the instruments or facilities of this center. Under the precondition of not affecting the usage right of the faculty and various NCKU units, this center may open part or all instruments and facilities for the use of people from outside the NCKU and charge them according to the approved standards.

 

第十一條           

申請人經核准使用各項儀器、設備時,須依照各項儀器、設備之使用規範或須知進行操作,除正常損耗外,如有故意或過失致儀器、設備破壞、毀損,或原操作功能部分減少,應負損害賠償責任,並得視情節經重,禁止或限制一定期間之使用。

Article 11           

Applicants shall operate the instruments and facilities in accordance with the use regulations and instructions they approved of before using such instruments and facilities. Except for normal wear and tear, users shall be held liable for compensating any intentional or unintentional damage or impairment caused to the instruments and facilities, or the reduction of their original functionalities. Users may also be banned from using said instrument or facility temporarily or permanently depending on the severity of the damage they have caused.

 

第十二條                

本中心種提供儀器、設備使用之服務,各項儀器、設備量測數據非經本中心同意,不符用於商業廣告之標示、法律訴訟之證據等其他用途。

Article 12           

This center provides only instrument and facility use services. All data measured using the instruments and facilities of this center cannot be used in commercial advertisement, as evidence of legal litigations, or for other purposes unless consented by this center.

 

第十三條           

本辦法經校務會議通過後施行,修正時亦同。

Article 13           

These regulations will be enforced after being passed in the University Council. The same rule applies for amendments.
