「關懷勞務承攬派駐人員權益工作小組」設置要點
National Cheng Kung University Directions on the Contracted Labor Rights Team

Passed at the 801st Meeting of the Chief Administrators Council on February 22, 2017

一、國立成功大學( 以下簡稱本校),為保障勞務承攬契約派駐勞工基本權益,特設關懷勞務承攬派駐人員 權益工作小組 ( 以下簡稱本小組 )。

1.The Contracted Labor Rights Team (hereafter referred to as the Team) is established by National Cheng Kung University (hereafter referred to as the University) to safeguard the basic rights of contracted workers.

二、本小組由副總務長及副學務長輪流擔任召集人,擔任會議主席, 置委員13人,由本校經辦勞務委外之總務處營繕組、採購組、事務組、學生事務處住宿服務組、圖書館等單位主管( 或代表)、秘書 室、法制組及人事室代表,及學生代表3人等組成之;並由住宿服務組及事務組 組長輪流兼任執行秘書。 必要時得聘本校法律教師 1人擔任顧問。

2.The role of team chairperson is alternatively undertaken by the Associate Vice Presidents of for General Affairs and Student Affairs. The team has 13 members, the roles of which are undertaken by representatives handling matters associated with labor outsourcing, namely representatives from the Construction and Maintenance, Purchasing, and General Service Division of the Office of General Affairs and the Housing Service Division of the Office of Student Affairs; managers or representatives from individual units such as the Library, Secretariat Office, Legal Section, and Personnel Office; and three student representatives. The position of executive secretary is alternatively undertaken by the directors of the Housing Service and General Service Division . When necessary, one law professor from the University is hired as a consultant to the team.

三、本小組每學期召開會議一次,必要時得召開臨時會議。 開會時得指定勞務承攬派駐勞工代表列席。

3.One meeting is held by the team each semester, and an nonstandard general meeting is held when necessary. During a meeting, contracted labor representative(s) may be present.

四、本小組督導範圍如下:

(一) 派駐勞工工作狀況。

(二) 派駐勞工薪賣給付狀況。

(三)  勞保、就業保險、健康保險及勞工退休金 之提繳。

(四) 職場性別平等概況。

(五) 派駐勞工申訴事件。

(六) 下年度合約之檢視。

前項第一至四款資料由勞務委外單位每月訪查提供,每勞務承攬案派 駐勞工人數每 10 人者提供 l 份,不足 10 人以 10 人計。

4.The scope of affairs supervised by the team is as follows:

(1)Work status of contracted laborers.

(2)Payroll of contracted laborers.

(3)Payment of labor, employment, and health insurance and labor pensions.

(4)Gender equality status regarding contracted laborers.

(5)Complaints by contracted laborers.

(6)Review of the contracts signed for the following academic year.

Data on Items (1)–(4) are provided by the labor outsourcing unit through monthly inspection. One dataset of said items shall comprise the profiles of at most 10 contracted laborers; any group of laborers fewer than 10 in number shall be counted as 10 laborers.

五、派駐勞工若有權益受損情形向本小組提出申訴,本小組將會同履約管理單位一起訪查申訴內 容。如承攬廠商有明確違反勞務承攬契約時,相關履約管理單位應依契 約約定要求承攬廠商限期改善或予以扣罰,並轉請勞工主管機關依法辦理。

5.Complaints filed by contracted laborers regarding a breach of their rights shall be jointly reviewed by the Team and contract management unit. If the outsourcing company involved is confirmed to have violated the labor contract, the contract management unit shall request improvement on the case within a limited time period by the outsourcing company or shall penalize the outsourcing company; in addition, the contract management unit shall request legal action from the competent labor authority.

六、本要點經主管會報同意後實施,修正時亦同。

6.These directions and any subsequent amendments shall be implemented upon approval by the Meeting of the Chief Administrators Council.
