一、國立成功大學(以下簡稱本校)為有效管理公共自行車租賃系統 CK-Bike(以下簡稱本系統),特 訂定本規則。

I. National Cheng Kung University (hereinafter referred to as NCKU) establishes these Regulations to manage the Bicycle Sharing and Rental System CK-Bike (hereinafter referred to as the “System”) effectively.

二、本系統係屬本校所有,提供甲地租車乙地還車之公共自行車自動化租賃服務。申請或使用本系 統時,即表示已閱讀、瞭解並同意接受本規則之所有內容。

II. The System belongs to NCKU and provides a bicycle sharing and automatic rental service that allows renting a bicycle in a place and returning it in another place. Any application for or use of the System will be deemed as having read, understood, and agreed to accept the provisions of the Regulations.

三、本規則相關名詞定義如下

(一)  會員:註冊組、人事室登錄之本校在職教職員工生。

1. 擁有數位識別證之在職職員、數位學生證之在校學生無需特別註冊。

2. 在校交換生或無數位識別證之在職職員須持本校相關單位身分證明,至本系統營運單 位之客服中心(以下簡稱客服中心)進行註冊。

3. 以信用卡於各租賃站之服務資訊站註冊,使用本系統服務者。

(二)  使用者:係指完成註冊與認證後,使用本系統服務者。

(三)  車輛定義:本系統自行車共可分兩類;CK-Bike 品牌車與 CK-Bike 環保車,範圍如下:

1. CK-Bike 品牌車:係指本校購買之相同規格原廠自行車。

2. CK-Bike 環保車:係指為體現資源環保再生之理念,收集本校之無主車或購買成本較低 之車輛,經重新修繕及改裝所提供之自行車。

III.  The terms used in the Regulations have the following definitions:

(1) Member: The current faculty and all the current students of NCKU who have been recorded in the Registrar Division and Personnel Office.

1.  No special registration is needed for the current staff members and students who have digital ID cards and digital student ID cards, respectively.

2.  The exchange students or the current staff members who do not have digital ID cards shall register in the service center of the unit that manages the System (hereinafter referred to as the “Service Center”) with identity certificate issued by the responsible department of NCKU.

3.  Registration can be performed with a credit card at the service information kiosk of any rental station to use the System's service.

(2)User: Any person who finishes the registration and certification and uses the System's service.

(3)Definition of bicycle: The System's bicycles are classified into CK-Bike Brand and CK-Bike Environment. The scope of each bicycle is described below:

1. CK-Bike Brand: means the bicycles with the same specifications and purchased by NCKU from an own brand manufacturer.

2. CK-Bike Environment: means the collected bicycles whose owners are unknown or the bicycles that NCKU purchases at a lower cost to materialize the ideal of environmental protection and recycling of resources. These bicycles have been repaired or modified before provided for use.

四、使用者註冊義務與隱私權保護如下:

(一)  為了能使用本系統服務,使用者同意以下事項:

1. 服務註冊時提供註冊所須之使用者本人正確、最新及完整的資料。

2. 維持並更新使用者個人資料,確保其為正確、最新及完整。若使用者個人資料變更、 教職員工證、學生證、信用卡遭到盜用或其他任何安全發生疑慮時,應立即與客服中 心聯絡。

3. 不得以竊盗、冒用等不當手法取得或使用他人之資料。若使用者提供任何錯誤、不實、 不完整或未更新的資料,本系統有權暫停或終止使用,並拒絕使用者使用本系統服務 之全部或部分。

(二)  隱私權保護: 關於使用者的會員註冊及其他特定資料,本校所有,並依「個人資料保護法」受到保護 與規範。使用本系統服務時,使用者同意在合理範圍內,依據「個人資料保護法」進行 使用者個人資料的蒐集與合法使用,包括本系統、本校帳務清算系統、電子票證及信用 卡發卡公司間的傳輸與儲存。

(三)  電子票證使用義務: 完成本系統服務的登記程序之後,申請者須維持電子票證及其電子錢包的機密安全。使 用者同意以下事項:

1. 不得以竊盜、冒用等不當手法取得電子票證證號。

2. 使用者的電子票證或其電子錢包遭到盜用或其他任何安全問題發生時,使用者應立即 通知客服中心。

3. 每次騎乘完畢將公共自行車停回本系統之停車區域,均確認歸還並過卡繳費。

(四)  兒童及青少年之保護: 依民法規定,如使用者屬無行為能力或未成年者,除應符合前款規定外,並應與使用者 的法定代理人人)閱讀、瞭解並同意本規則之所有內容後,方得使用或繼續使用本系統服 務。使用者使用本系統服務時,推定使用者的法定代理人已閱讀、瞭解並同意接受本規 則之規範。

IV.  The obligation of the user to register and the protection of the privacy are described below:

(1)The user agrees on the following in order to use the System's service:

1. Provide the correct, latest, and complete personal information needed for the registration when registering for the service.

2. Maintain and update the personal information of the user to ensure its correctness, latest status, and completeness. Contact the Service Center right after the personal information of the user is changed, any faculty's ID card, student ID card or credit card is stolen, or any other concerns about safety occur.

3. No stealing, fraud, or other improper approaches are allowed to acquire or use the information of others. Where the user provides any erroneous, fraudulent, incomplete, or obsolete information, use of the System may be suspended or terminated and access of the user to all or part of the System's service may be refused.

(2)Protection of privacy: The information about the registration of the user for the membership and other specific data shall be vested in NCKU and protected and governed in accordance with the “Personal Information Protection Act”. When using the System's service, the user agrees that the personal information of the user may be, within a reasonable range, collected and used legally in accordance with the “Personal Information Protection Act”, including the System, NCKU Account Settlement System, electronic stored value card, and the transmission and storage between credit card issuing companies.

(3)Obligation to use electronic stored value cards: After carrying out the registration procedure for the System's service, the applicant shall maintain the confidentiality and safety of his/her electronic stored value card and e-wallet. The user agrees on the following terms and conditions:

1. No stealing, fraud, or other improper approaches are allowed to acquire electronic stored value cards.

2. The user shall contact the Service Center right after his/her electronic stored value card or e-wallet is stolen or any other problems of safety occur.

3. When parking the shared bicycle in the parking area of the System every time after the ride, confirm the return and make the payment with the card.

(4)Protection of children and teenagers: As the Civil Code specifies, a user who has no capacity to make juridical acts or is a minor shall, in addition to compliance with the previous paragraphs, read, understand, and agree on all the provisions of the Regulations together with his/her guardian before the user is allowed to use or continue using the System's service. When the user uses the System's service, the guardian of the user is presumed to have read, understood, and agreed on the provisions of the Regulations.

五、使用服務及騎乘注意事項:

(一) 使用者充分了解並同意此註冊行為在於申請本系統服務之使用,而非本系統服務之保證 使用。本系統服務為公共設施,單一租賃站之車輛及空間有限故不保證使用者每次可租 車及還車,請至其他租賃站租賃與歸還。

(二) 使用者不得為任何非法目的或以任何非法方式使用本系統服務,並承諾遵守「道路交通 安全規則」及「道路交通管理處罰條例」等法規。使用者同意並保證不得利用本系統服 務從事侵害他人權益或違法之行為。

(三) 本系統服務提供之對象,受限於車輛設計,限於身高 140 公分以上,且 190 公分以下 之使用者。

(四) 若使用者未能如期歸還自行車,應主動與本系統客服中心聯絡。使用者啟用自行車自租 賃開始,經 24 小時而未歸還者,客服中心將以電子郵件進行聯絡,並視情況連絡警政單 位協助查詢。使用者若遺失自行車須立即通知客服中心,並向鄰近警察局報案,將報案 聯單送至客服中心,停止計算租借時間。

(五) 如有報案並取得報案聯單者,則暫不需要支付賠償費用,如逾 3 個月尚未尋獲,遺失若 可歸責於借用人,借用人應負賠償之責,賠償金額 CK-Bike 品牌車每台新臺幣(以下 同)10,000 元,CK-Bike 環保車每台 2,000 元。若未報案者,則依逾期未歸認定,客服中心 將主動聯繫該使用者儘速歸還,若仍未歸還,則依相關法令究責。

(六) 使用者持已註冊數位識別證,至本系統公共自行車自動化租賃站感應取車;一人僅得註 冊一張票券。每次騎乘完畢並停妥本系統公共自行車自動化租賃站,均須確認歸還並感 應電子票券,以確保完成租還車流程。

(七) 本系統之公共自行車僅限單人騎乘,不得搭載乘客,不得載送違禁品、危險品、不潔或 易於污損公共自行車之物品、不適宜隨車之動物類、影響騎乘安全之物品。

(八) 使用者使用期間,若有違反「道路交通安全規則」及「道路交通管理處罰條例」等交通 法規所衍生之處罰案件,罰鍰部分應由使用者負責繳清;另公共自行車被扣留,從被扣 留之時起至被通知得領回之時止之租金,由使用者負擔。

(九) 使用者如發生擦撞或毀損,除有不可歸責之情形外,應立即報案並通知本系統客服中心 處理,如因可歸責於使用者致衍生之拖救費、修理費、公共自行車修理期間之租金及折 舊費,或造成第三人之一切損害,應由使用者全數負擔。

(十) 使用者應盡善良管理人注意義務保管及維護本系統公共自行車,禁止出賣、質押、典當 等行為。如因歸責於使用者,致損壞或失竊者,除報請警政機關協助處理外,損壞或尋 獲之公共自行車所有權仍屬本校所有。

(十一)    本系統提供公共意外責任險,範圍為租賃站及其周邊範圍,但不提供個人意外保險, 如有需要應自行投保。

(十二)    以上如有未盡事宜,悉依相關法令辦理。

(十三)    依統一發票使用辦法第 4 條第 3 款規定,計程車業及其他交通運輸事業客票收入部分, 得免用或免開統一發票,欲查詢消費紀錄請至各租賃站之服務資訊站進行查詢。

V.     Instructions on use of the service and riding:

(1)The user fully understands that the purpose of the registration is to apply for use of the System's service rather than guarantee its availability. The System's service is provided as a public facility. Since the space of a single rental station is restricted with limited bicycles available, no guarantee is granted to ensure that the user can always rent or return the bicycle. In this case, the user is requested to rent or return the bicycle at another rental station.

(2)The user is not allowed to use the System's service for any illegal purposes or in any illegal manner. The user undertakes to observe the “Road Traffic and Safety Regulations”, and the “Road Traffic Management and Penalty Act”. The user agrees and guarantees not to use the System's service to commit any infringement on the rights and interests of others or engage in any illegal conduct.

(3)Subject to the design of the bicycle, the System's service is only provided to users who are more than 140cm and less than 190 cm in height.

(4)User who cannot return the bicycle on time shall contact the Service Center at their own initiative. Where the user does not return the bicycle 24  hours after enabling and starting the rental of the bicycle, the Service Center will contact the user by email and, if appropriate, contact the police department to assist with the investigation. In case the bicycle is lost, the user shall contact the Service Center immediately and report it to the nearby police. The user shall submit the reporting certificate to the Service Center to stop calculating the rental time.

(5)Payment of damages is not required provisionally if the user reports the loss to the police and acquires the reporting certificate. In the event that the bicycle is not recovered after 3 months and the loss is attributable to the user, the user is responsible for damage compensation to the amount of NT$ (the same below ) 10,000 (CK-Bike Brand) or 2,000 (CK-Bike Environment) per bicycle. The bicycle shall be deemed not returned beyond the due date if the loss is not reported to the police. The Service Center will contact the user and ask the user to return the bicycle as soon as possible. If the bicycle is not returned nevertheless, an investigation shall be carried out for responsibility pursuant to the relevant laws and regulations.

(6)The user holds the digital ID card that has been registered and takes the bicycle by scanning and inducing the card at a bicycle sharing and automatic rental station. One user can only register for one card. When parking the bicycle at a bicycle sharing and automatic rental station every time after the ride, confirm the return and scan the electronic stored value card to ensure finishing the rental and return procedures.

(7)The System's shared bicycles are provided only for one rider and shall not be used with a passenger or for transport of contraband, dangerous or dirty goods, or any objects that may contaminate the shared bicycle easily, or animals that are not suitable for transport with bicycles, or such objects that may affect the riding.

(8)The user shall pay any fines for any violation of the “Road Traffic and Safety Rules” and the “Road Traffic Management and Penalty Act” occurring when the user is using the bicycle. In case the bicycle is detained, the user shall pay the rent for the period from the date of detention to the date of notification when the bicycle can be taken back.

(9)In case of a fender bender or damage, the user shall immediately report it to the police and notify the Service Center to take further actions except in circumstances not attributable to the user. The user shall take full responsibility for the towing and repair fees, the rent during repair of the shared bicycle, the depreciation cost, and all the damages to any affected third party deriving from the factors attributable to the user.

(10)The user shall take care of and protect the System's shared bicycles with the due care of a good administrator and shall not engage in any selling, pledging, or pawning conduct. Where the bicycle is damaged or stolen in circumstances attributable to the user, in addition to reporting it to the police for assistance with the investigation, the ownership of the damaged or recovered bicycle shall be vested in NCKU.

(11)The System provides public liability insurance with a coverage of the area at and around the rental station. No personal accident insurance is provided and the user shall take it out by himself/herself if needed.

(12)All the matters not covered by the Regulations shall be subject to the relevant laws and regulations.

(13)As specified in Article 4, Subparagraph 3 of the Regulations Governing the Use of Uniform Invoices, the passenger fare income of taxi operators or of other transport businesses may be exempted from the use or issuance of uniform invoices. To check the record of consumption, please go to the service information kiosk at any rental station.

六、本系統租賃費率標準如下:

(一) 使用數位式教職員工證、學生證每次租賃後 1 小時內為免費使用。歸還時若逾免費時間, 由電子票證進行扣款,每逾 30 分鐘 5 元,未滿 30 分鐘以 30 分鐘計算。

(二) 使用信用卡,每次租賃每 30 分鐘 10 元,未滿 30 分鐘以 30 分鐘計算。於交易完成後, 刷卡進行交易扣款。

(三)  本系統於試營運、特定活動期間,費率另行公告之。

VI.   The rental rate and charging standard of the System are described below:

(1)The bicycle is used free of charge for 1 hour every time after renting it using the digital faculty or student card. Where the bicycle is not returned beyond the period of exemption, a payment will be deducted from the electronic stored value card to the amount of 5 dollars every 30 minutes after such period. The time less than 30 minutes will be calculated as 30  minutes.

(2)Where the bicycle is rented using a credit card, 10 dollars will be charged every 30  minutes and the time less than 30 minutes will be calculated as 30 minutes. The payment will be deducted by scanning the credit card after the transaction is completed.

 (3)The rental rate of the System will be announced separately for the period of trial run or any special event.

七、服務變更、終止、暫停或中斷

(一) 本系統得因限於一定期間未使用、法院或政府機關命令、使用者自行請求、本系統服務 無法繼續或服務內容變更、無法預期之技術或安全因素或問題、使用者違法使用、未支 付費用,或其他已經違反本規則規定,而終止使用本系統服務之權利。亦得依本系統自 行之考量,於通知或未通知之情形下,隨時終止本系統服務或其任何部分。使用者同意 依本系統服務管理規則任何規定提供之本系統服務,無需進行事先通知即得終止,使用 者承認並同意,本系統得立即關閉或刪除使用者的註冊,並停止本系統服務之使用。此 外,使用者同意若本系統服務之使用被終止,對使用者或任何第三人均不承擔責任。

(二) 使用者同意使用者註冊之電子票證及帳號不可轉讓予任意第三人,且使用者於本系統註 冊之任何權利,於接獲使用者本人、代理人或受託人之通知或依警察檢調機關之要求停 止使用本系統服務,或使用者連續二年以上未使用本系統服務,或自本系統取得使用者 的死亡證明文件所載之死亡時間起,使用者的帳號將被終止,本系統並得刪除帳號相關 資料及交易紀錄。

(三) 若有不當使用本系統服務者,本系統有權暫停或終止使用,並拒絕使用者使用本系統服 務之全部或部分。

VII.  Change, termination, suspension, or discontinuation of the service:

(1)The System's service may be terminated in the circumstances where the System is not used for a specific period of time, the court or government agency gives an order, the user makes a request, the System's service cannot be continued or is changed, unexpected technique or safety factors or problems occur, the user uses the System's service illegally or does not pay the fee, or other violations against any provision of the Regulations. The System may, at its own discretion, terminate the service or any part of the System at any time with or without prior notice. The user agrees that the System's service provided pursuant to any provision of the regulations governing the management of the System service may be terminated without prior notice. The user acknowledges and agrees that the System may close or erase the registration of the user and terminate the use of the System's service directly. In addition, the user agrees that the System does not bear any responsibility to the user or any third party in case the use of the System's service is terminated.

(2)The user agrees not to assign the electronic stored value card and account that the user registered to any third party, and the account of the user, including any and all the rights that the user registered in the System, will be terminated as from the date on which a notice is received from the user, his/her agent or designated person, the police, procurator or investigation office requests to stop using the System's service, the user has not used the System's service for more than 2 consecutive years, or at the time of death indicated on the death certification document of a user that the System acquires. In this case, the System may erase the information and transaction records related to the account.

(3)Where the user provides any erroneous, fraudulent, incomplete or obsolete information, use of the System may be suspended or terminated and access of the user to all or part of the System's service may be refused.

八、廣告:

使用者在本系統服務中瀏覽到的所有廣告內容、文字與圖片之說明、展示樣品或其他銷售資 訊,均由各該廣告商、產品與服務的供應商所設計與提出,經本校同意給予刊登。但使用者對 於廣告之正確性與可信度仍須自行斟酌與判斷,使用者因該廣告而受有損害者,本校不負任何 賠償責任。

VIII. Advertisement:

All the advertisements, texts, and picture descriptions, demonstrated samples or other sales information that the user reads in the System's service are designed and offered by the respective advertising agencies and product and service providers and are published with NCKU’s approval. However, the user shall consider and judge the correctness and the credibility of the advertisement carefully and NCKU is not responsible for any compensation in case the user sustains any damage in use of the advertisement.

九、免責聲明

(一) 使用者明確了解並同意,本校對本系統服務不提供任何明示或默示的擔保,本系統「現 狀」及「提供使用時」之基礎提供,使用者使用本系統服務時,須自行承擔相關風險。 本系統不保證以下事項:

1. 本系統服務將符合使用者的需求。本系統服務不受干擾、及時提供、安全可靠

2. 或無錯誤。

3. 本系統服務之使用而取得之結果為正確或可靠。

4. 使用者自本系統服務取得之建議和資訊,無論其為書面或口頭,均不構成本系統服務 之保證。

(二) 本系統中斷或停電,除不可抗力之因素(含天然災害及電信業者因素),本系統將提前公告 之。於中斷或停電時間內歸還之自行車,以系統中斷或斷電之起始時間結算租金。惟對 於使用者因使用或無法使用造成的損害,本校不負任何賠償責任。

IX. Disclaimer

(1)The user explicitly understands and agrees that NCKU does not provide any guarantee, whether express or implied, for the System's service. The System's service is provided on an “as is” and “as available” basis and the user shall assume the related risks when using the System's service. The System does not guarantee the following:

1. The System's service meets the requirements of the user. The System's service is not interrupted or is provided in time and in a safe and reliable manner.

2. The System's service does not have errors.

3. The result from using the System's service is correct or reliable.

4. No advice or information that the user acquires from the System's service, whether written or oral, constitutes a guarantee for the System's service.

(2)Except for force majeure (including natural disasters and factors attributable to the telecom service provider), the System will publish an announcement of interruption or power outage in advance. For a bicycle returned during an interruption or power outage, the rental is calculated until the time when the interruption of the System or power outage occurs. However, NCKU does not take any responsibility for the compensation in case of any damage that the user incurs due to use or unavailability of the System's service.

十、本規則增訂或修改: 本校得於任何時間修改或變更本規則之內容,使用者隨時注意本校公告。若使用者於在公告後 繼續使用本系統服務,視為已閱讀、瞭解並同意接受公告修訂內容。如使用者不同意本規則的 內容,應立即停止使用。

X.    Supplementation or amendment of the Regulations: NCKU may amend or change any provisions of the Regulations at any time. The user shall pay attention to the notice in the campus from time to time. A user who uses the System's service after the announcement shall be deemed as having read, understood, and agreed to accept the contents of the amendment. A user who does not agree on any provision of the Regulations shall stop using the System's service.

十一、  本規則經校園交通管理委員會通過後,經校長核定後實施,修正時亦同。

XI.   The Regulations and any amendments thereto shall take effect upon adoption at the meeting of the Campus Traffic Management Committee and approval from the President.
